BONIEK TRIAL: WHY IT MATTERS TO YOU ,WHY YOU SHOULD CARE

THE CONVICTION OF REPRESENTATIVE BONIEK

Sunday, June 9, 2013, 6:13 PM

In May of this year, Joel Boniek of Park County, Montana was convicted by a jury of fleeing or eluding a peace officer, resisting  arrest and obstructing a peace officer.  This while
Boniek was traveling on a private road, going to his home which was threatened by a grass fire.
For this so-called crime, a misdemeanor, Boniek was threatened with death by Trooper Sulages and Deputy Sheriff Hopkin, and Hopkin said under oath that he would have shot/killed Boniek if he had driven past Hopkin.
After a trial full of irregularities, Prosecutor Carrick said in her closing statement that people must be controlled by law enforcement officials and public servants. She said if we are not controlled by government people, there will be chaos and disorder, even criminality.
This is insulting, demeaning, and illogical.  Every responsible man or woman should be outraged at this idiocy.
It is not because of  police who come and take a report after a crime that we are safe. We live in peace because nearly all of us are peaceable people.
Carrick obviously does not recognize that society is self organizing.  It is not because of government that we have food, housing, goods, recreation, worship, business, charity and jobs.  We have these things because people naturally do these things in a free society.  All the things government does can be done by private initiative in a free society. In Park County, we have fire protection because of VOLUNTEER fire crews. ANY power government has is delegated to it by the people, to be used to protect our rights.
In  the American system, government is instituted to protect the rights of the people to order their lives as they see fit. “To secure these rights, governments are instituted among men.”  Declaration of Independence.
Joel Boniek was doing  his natural, God-given and Constitutionally protected duty to see to the protection of his family, home and animals.  He was violently prevented from doing this by officers who ought to first protect and serve the people.  Carrick used public resources to enforce this outrage, and the jury put its stamp of approval on this action.  Potential jurors who knew the issues and did not agree with the government’s action were excused.
So, the message to all the people is, “You will be controlled by the government, your duty and rights are irrelevant, and you may next be threatened with death if an officer thinks you are defying his authority.”  (In Montana, you can be arrested even if the arrest is illegal! Makes you wonder what the legislature was smoking when they did this clever move.) “If you are not part of the government, you are irresponsible and incompetent.”
You might rightly ask yourself, “What moral, ethical or philosophical system justifies using violence or the threat of violence against a man who has not harmed anyone?” This is not the way of Freedom or America.
The crucial question is, do we want a government that controls our lives, or that protects our natural and God given rights? The founders of America were clear in what they envisioned.  Joel Boniek agrees with the founders.
An appeal of Boniek’s conviction has been started.  He could use your help and encouragement if you value and believe in the American system passed down to us.  This is a matter of principle, and he is standing for your freedom and self determination, as he stands for his.  He could have made a deal with the government, and let the situation continue to get worse.  But if freedom is taken away in small steps or large, it goes away just as surely.
Ask yourself:
Do you think that a policeman should be free to shoot you as you go peacefully about your lawful business, just because that policeman decides on a whim that he disapproves of what you are doing?

Do you think that the judicial system should condone and perpetrate the exclusion of God, the constitution, the credentials of public servants (whether or not the public servant properly hold their offices), the proper role of the jury in American justice,  and lack of due process?

Do you think it is right to exclude from "Volunteer Firefighters" the volunteer help of the homeowner whose property is burning?

Do you think policemen should harass and attack people in desperate situations instead of helping them?

If you say no. then this case is working for you. Would you consider helping support this effort?

BULLET POINTS – WHY IT MATTERS
·      The proper role of government is to secure our rights, not control us.  This is not the case in Park County.
·      The official position of government and “peace” officers in Park County is that the people are irresponsible and must be carefully supervised. This ought to offend everybody.
·      Park County public servants, led by Fire Chief Dan Babcox, do not respect our property rights.  This needs to stop.
·      Law officers threatened to shoot a peaceful man.  Each one of us must now be afraid we will be next.
·      These excesses will not become fewer, since they have been validated. The trend must be reversed.
·      Officers in Park County are not tasked with serving and protecting.  They supervise and control.  They have become our masters, rather than our servants.
·      The judicial process has become less just and right.  The prosecutor asked that there be no references to God, the constitution, oaths or bonds of public servants, laws,  fully informed juries, and more.  This is un-American.
·      Fires are fought by volunteer crews.  The DNRC promotes landowner and fire crew cooperation.  This is not the norm in Park County.  This needs to change.

Your help and support is requested and appreciated.  If you have a word of encouragement or support, let me hear from you.  If you can give support, thank you!

Sincerely,
Joel Boniek

Joel Boniek

Welcome to the police state - Joel Boniek- Livingston, Montana Wildfire Roadblock

Dear Liberty-Minded Friends,

Joel
The Honorable Joel Boniek, former Montana Legislator, Oath Keeper, American Patriot rode to work at the Montana State Legislature on his faithful companion, Jesse
Things can only change in our corrupt justice system if YOU play a role in that change.  In my view, the outrageous and despicable treatment Joel Boniek received from police and the courts was nothing less than deliberate and unfounded.  This case is a classic example of the "system" wanting to make an example of someone like Joel, who has always stood up for you, for the Constitution and for truth.  Now, it's time for us to stand up for Joel.
This corruption must be exposed in it's entirety and We The People must turn this around and make an example of THEM!
This senseless situation Joel Boniek has found himself in could have easily happened to you, or to me.  That is why I'm asking you all to stand with Joel and be there to support him until true Justice is served.  Furthermore, we can prevent an incident like this from ever happening again.  Are you with me?

For Liberty,
Joan Stanley

Comment from Joel Boniek

Da Vinci Monday, 7 Jan at 3:00pm at the Livingston city county building, basement.
It is a continuation of the omnibus hearing of November which was adjourned because of an interruption.
I have no idea what to expect. I believe that certain matters are supposed to be taken up at an omnibus,(probable cause, constitutional matters, jurisdiction, pretrial motions, etc.) but I was denied that last time. It was looking like it was going to be only a trial scheduling hearing. (lack of due process)
I welcome each and every witness and encourager! The interest and support of good people is what is saving me.
You and friends are welcome! Last time there was 30+, it would be great to see many more.
My only defense is God and public support.

Joel

Take A Stand Before There Will Be Nothing Left To Stand For
Oath Keepers

On one hand, I hate to see the kangaroo court interrupt our productive lives. On the other hand, I feel an obligation to stand behind the man who has stood in the gap for freedom. If we don't stand soon, there will be nothing left to stand for.

If you are not aware of what this is about, please read below.

In a nut shell. The courts are something less than stellar. Joel demonstrated the people claiming to be authorities are impersonating the authority position. They are not legitimate. We have been letting the "authorities" walk on us for years. Joel and other citizens stood last November requiring legitimate due process guaranteed by law and the Constitutions folks swear by, in order to hold these positions.
The court was shocked and crumbled under Joel's methodical, controlled and respectful questioning. This is the follow-up to that.
Why was Joel in court. He attempted to protect his private property from wildfire. He was violently prohibited from doing so. The authorities should be explaining to Joel, rather than Joel doing the explaining.
If you really believe in Liberty, Law and the American way of life, now is your opportunity to stand.
If many stand, violence and abuse will be avoided. If a few stand, it is very possible the few will be abused, oppressed and violated. I suspect it will only be a matter of time before you and I will be in such a position looking for support.

Note from Elias Alias -

All who possibly can will show up early for the hearing for Joel Boniek at Livingston, Montana this Monday. (See below for details.) A large group of honorable citizens representing a cross-section of the tax base in Park County should be backed by liberty activists and freedom groups from around the State, such as Mark French’s contingency coming down by bus from the Plains/Kalispell area of the State.
Please read why in Joan Stanley’s Montana Messenger, below. And remember – Gandhi and Martin Luther King showed us the power which people have in numbers, and their eternal counsel is that we do things with dignity and peace. This is not to be a confrontation. It is a show of support for a good citizen who’s reputation could be scarred over something quite petty. It is also a way in which we can do our duty as “We The  People” to assert anew to local and County government the rights of individual property ownership.
The community should envision a more freedom-friendly use of peace officers, and the citizenry of Park County should encourage all peace officers to respect unalienable rights which supersede governmental authority, property ownership rights included. A quote-unquote “criminal justice system” cannot properly apply charges of criminal intent to a man who found a way around a state-imposed obstacle as he rushed to save his property in the face of a wild fire. All land-owning Montanans should stand together on that much, and government itself should re-affirm the sanctity of property ownership by stepping back on this one.
It is important that Joel has his time with the Judge. But it is also important that he has the support of concerned citizens. Please be there if you possibly can. I concur with Joan Stanley in this and would be pleased to know that many Oath Keepers hats and shirts will be present. I envision a hundred or more patriots standing peacefully outside a packed court room – standing silently and respectfully in the deep strength of neighborly support.
Peace on Earth,
Salute!

Montana Courtroom Incident Proves Wild Fire Can Burn Twice

This story should make national headlines since Joel Boniek was the legislator that sponsored the Montana Firearms Freedom Act that has gone viral around many states.  Pour on the truth Joel, and let us know how to help spread this story.
This remarkable story begins with a wild fire in Paradise Valley, Montana, south of the small City of Livingston. The valley is aptly named, as it runs from Yellowstone National Park northward all the way to Livingston, Montana. The valley uses steep mountains to showcase the Yellowstone River in scenic beauty renewed and refreshed with every bend as the river winds its way through the silent majesty of Rocky Mountain ranges between Gardiner and Livingston.
Months after a wild fire was quenched, its flames have resurrected to envelop a courtroom in Livingston, Montana with a fiery exchange which has sparked fear and defensive psycho-babble in the hearts of a vociferous huddle of collectivists who are trying to forge a new culture in Montana. At their service is a newspaper cadre which serves up the Progressive perception for readers far and wide.
The culture clash between recently arrived statists and old-fashioned Montanans ignited in a spontaneous combustion in a small courtroom in mid-November, 2012, when a man wearing a three-cornered hat, like that of our forefathers of the American Revolution, stood up and bellowed to the judge in a loud, rich, baritone voice, “Bull Sh*t!”.
What happened next has been wildly misinterpreted in headlines around Montana as the state-worshipping collectivists and socialists of the press were quick in their attempt to douse such a flame, the flame of freedom, the fiery individualist rejection which dared challenge governmental authority. In their misrepresentation and mockery, the press has maligned a former State Representative’s character.
To help readers understand, here are a few of the headlines going about the Internet and some Montana newspapers. We will rebut these headlines and expose the shameful intent of the press further down in this article.

The Ron Pauls of Montana. Who are the real leaders?

Two Oath Keepers are standing up for Freedom by running for the top two seats in Montana’s government. Former Montana Representative Joel Boniek is running for Lieutenant Governor and Rancher Bob Fanning is running for Governor.

Billed as the Fanning-Boniek Revolution by supporters, these Patriots are card-carrying Oath Keepers. Bob and Joel are liberty leaders working hard to bring Montana back under the rule of Constitutional law in the strictest sense. Their plan for ending Federal over-reach into state interests will open Montana’s natural resources, re-establish Montana sovereignty, institute an alternative sound money system based on Montana’s abundance of precious metals and minerals, and reinstate the Constitutional militia at the County-Commission level across the State, thereby showing all citizens how all of us together can become our own local government by Constitutional means.

A quick visit to http://www.fanningforgovernor.com will provide you with an abundance of information on their platform, which is drawing keen interest across Montana. Competing political candidates, (all talking conventional Party rhetoric), react with awe at the Fanning-Boniek Revolution’s boldness and plain spoken solutions to both State and National issues faced by all Americans.

Their candor and drive have brought into the fray some impressive support from within Montana and from out of State, including endorsements from G. Edward Griffin and Dr. Edwin Vieira, Jr,

If you would like to see a clear State challenge to Federal intrusion, join Bob and Joel as the “Ron Paul” Gubernatorial ticket in Montana matches the courage and patriotism of Presidential candidate Ron Paul. Read their exciting “Declaration of Independence”

It is well known that when states stand together to protect your civil liberties and Constitutionally protected freedoms, Montana is often a cornerstone in such battles. In this time of over-reaching federal mandates, Trillion dollar debts that will be left to your children, low political ethics and ever growing government, we ask that you help us send the Fanning-Boniek Revolution for Freedom VIRAL. Please forward this email to every person in your mailing list, for though this campaign is in Montana, its influence will touch, (and support Liberty for!), every person and State in America.

At their website, remember to sign up for insider email updates and reports, and as your spirit guides you, please contribute to the campaign that in 2012 will re-establish Montana’s and America’s sovereignty, freedom and prosperity … the old fashioned American way. G Edward Griffin endorses Bob Fanning for Governor of Montana

CANDIDATE FOR GOVERNOR IN MONTANA APPOINTED TO HALL OF HONOR

2012 Apr 4 from GEG:

One of the slogans of Freedom Force International is: 'Why fight City Hall when you can BE City Hall?' In reviewing the Montana Gubernatorial campaign platform of Bob Fanning, I am happy to see that he and his Lt. Gov. running mate, Joel Boniek, are putting that slogan into action. They are promising a return to the principles of a constitutional republic in the strictest sense. They are advocates of sound money and a people’s militia, exactly as prescribed in our Constitution.

Their platform includes reintroduction of a county militia in each of Montana’s fifty-six counties, providing a sensible and lawful method for citizens to protect their local governments and provide true "homeland security."

Bob Fanning is aware of the mischief of the Federal Reserve System and the threat it poses to Montanans. His plan is designed to eliminate state dependency on federal funds, stimulate the development of local wealth in its place, and apply the principle of state sovereignty, as authorized in the Tenth Amendment of the Constitution, to protect personal freedom and state independence of federal control over local matters.

Bob Fanning and Joel Boniek are offering Montana a real choice for freedom and prosperity. It is my hope that voters will seize this opportunity to reverse the trend into subservience to big government and get behind Bob’s “Montana Declaration of Independence”. To that end, I offer my endorsement for his platform and am proud to announce that he has been placed in the Freedom Force Hall of Honor for his dedication and service to the principles of liberty.
