Update on the Montana Grand Jury!

Put the teeth back in our system of government as a first check and balance against abuse of the people by elected and appointed officials including Sheriffs, Justices of the Peace, and all the Judiciary or any other person getting a paycheck from government who has sworn an oath to obey, protect, and defend the Constitution against all enemies, foreign and DOMESTIC.
Only those who have something to hide would oppose this Grand Jury.

The Office of Montana’s Secretary of State Has Accepted a Draft Ballot Initiative Seeking to Provide the Citizens of Montana the Ability to Summon Grand Juries By Petition

Stevensville, Montana, November 10, 2009 – The office of Montana’s Secretary of State (SOS) in Helena has accepted a ballot initiative, to be reviewed by the office of Legislative Services. This is the beginning stage of placing the initiative on the 2010 general election ballot.
This initiative has been labeled ‘Ballot Issue #18’ by the SOS, and is a Constitutional Initiative (CI), seeking to amend Montana’s Constitution, providing for the ability of the citizens to summon Grand Juries by petition.
Currently, the Montana Constitution only provides that a District Judge, at their discretion, may summon a Grand Jury. Article II, Section 20, Paragraph 2 states: “A grand jury shall consist of eleven persons, of whom eight must concur to find an indictment. A grand jury shall be drawn and summoned only at the discretion and order of the district judge.”
Serving as a ‘check and balance’ for the Constitutional Republic known as the United States, the Founders had preserved for the citizens, the right and ability to assure that the public servants kept their activities in line with the intent of the Constitution, and its Bill of Rights, which were ratified on December 15, 1791. The term Grand Jury is mentioned only in the 5th amendment to the United States Constitution. It is meant to be a right retained by the people. It is a citizen function, not a government function, as the public has been lead to believe.
What do the courts have to say?

“An independent grand jury is to stand between the prosecutor and the accused, and to determine whether a charge is legitimate, or is dictated by malice or personal ill will.”

”Hale v. Henkel, 201 U.S. 43 (1906)

The Supreme Court states that the independent grand jury’s purpose is not only to investigate possible criminal conduct, but to act as a “protector of citizens against arbitrary and oppressive governmental action,” and to perform its functions; the independent grand jury “deliberates in secret and may determine alone the course of its inquiry.”
United States v. Calandra, 414 U.S. 338 (1974)

Article IV, Section 4 of The United States Constitution says: “The United States shall guarantee to every State in this Union a Republican Form of Government …” And, Montana is this form of government. As such, the Montana Constitution states in Section 1: “Popular sovereignty. All political power is vested in and derived from the people. All government of right originates with the people, is founded upon their will only, and is instituted solely for the good of the whole.”

And, in Section 2: “Self-government. The people have the exclusive right of governing themselves as a free, sovereign, and independent state. They may alter or abolish the constitution and form of government whenever they deem it necessary.”

The Founders’ intended for the sovereign citizens to ‘lend’ the public servants their specific duties. Among these is the preservation of constitutionally protected rights. The servants are not in a position, and do not have the ability to take away these sovereign, constitutionally secured rights and powers of the people.

Amending Montana’s Constitution as indicated will serve to restore the Founders’ intent, at the state level, regarding the position of, and political responsibilities required by, the citizenry.

ANGER WITH FEDERAL GOVERNMENT NOT ENOUGH

The States are the Answer. Grand Juries are the teeth. Replace the Judges, Sheriffs, and legislators who are not keeping their Oath of office to Defend, protect and OBEY the Constitution.
Start at the local level. The US Government is a creature of the States. Any one who opposes the formation of a standing citizen's Grand Jury must have something to hide. You will find most of the oppostition gets a paycheck from government. Those opposing the Grand Jury need to be investigated most.

According to Rasmussen Reports, "Seventy-one percent (71%) of voters nationwide say they're at least somewhat angry about the current policies of the federal government. That figure includes 46% who are Very Angry.
"The latest Rasmussen Reports national telephone survey finds that only 27% are not angry about the government's policies, including 10% who are Not at All Angry."

The report goes on to say, "The data suggests that the level of anger is growing. The 71% who are angry at federal government policies today is up five percentage points since September.

"Even more stunning, the 46% who are Very Angry is up 10 percentage points from September."

Anger and opposition to Washington's policies and edicts--no matter now egregious--hardly ever translate into anything beyond words of frustration. And Washington politicians don't pay much attention to rhetoric--not even their own.

Therefore, it is absolutely obligatory that freedom-minded Americans refocus their attention to electing State legislators, governors, judges and sheriffs who will fearlessly defend their God-given liberties. And, as plainly and emphatically as I know how to say it, I am telling you: ONLY THE STATES CAN DEFEND OUR LIBERTY NOW! And awakening to this reality means we will have to completely readjust our thinking and priorities.

If we had more State legislators such as Washington State's Matthew Shea; Georgia's Bobby Franklin; Pennsylvania's Sam Rohrer; New Hampshire's Dan Itse; Michigan's Paul Opsommer; Oklahoma's Randy Brogdon, Sally Kern and Charles Key; Montana's Rick Jore, Greg Hinkle, and Joel Boniek; Tennessee's Susan Lynn; South Carolina's Michael Pitts and Lee Bright; Missouri's Jim Guest and Cynthia Davis; and sheriffs such as South Carolina's Ray Nash, Arizona's Richard Mack and Joe Arpaio, Montana's Jay Printz and Shane Harrington, etc., it wouldn't matter what those nincompoops inside the Beltway do. The federal government cannot violate your rights and steal your freedoms without the consent and approbation of your State government.

HOPE FOR FINANCIAL FREEDOM?

I have been saying and writing for years that the fiat money system is no more or less than the PLUNDER OF AMERICA UNDER THE COLOR OF LAW. It's fraud by big banksters. It's a con game. Paper is confidence currency, and when the public loses confindence it will go to it's true value, which is ZERO

Reading this article by Tim Baldwin will tell you what that is based on.

The financial system our federal government created in 1913 and thereafter maintained has created nothing but iron chains around the hands, feet and necks of the states of America.
Unfortunately, most Americans do not understand the unconstitutionality and dangers of this system (mostly because of a lot of brainwashing over the years). When politics begin to affect the wallet, however, many Americans all of a sudden become politically active and “righteously” indignant. This sadly reveals that principles of truth are not priority. But if a person even cares about America’s history, principles of freedom as accepted by our forefathers or the natural and revealed laws of God, he has to admit that one of the most fundamental elements of freedom is financial freedom. These fundamentals confirm the right of individuals to work in exchange for other items contracted for by the engaged parties, to reap all the benefits and rewards of his labor, skill and intellect without the unjust or unauthorized interference of anyone else, including government. Our Declaration of Independence categorizes this natural right as the “pursuit of happiness,” meaning property, which money certainly is.

Despite financial freedom being considered a natural right, our federal government has ignored this right and principle of freedom; and today, it controls virtually every aspect of money, starting with money’s very creation (i.e. printing) through the inaptly-named, Federal Reserve System (created in 1913 by Congress). But the idea of this system did not come from our forefathers. In fact, based upon the principles of individual freedom, self-government and limited government, our founders rejected the federal government’s power to print money by giving only this power to Congress in Article 1, Section 8: “To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures.” Moreover, States agreed (by ratification of the U.S. Constitution) that they would only be limited as follows relevant to money and currency: “No State shall…make any Thing but gold and silver Coin a Tender in Payment of Debts.” Since 1913, the federal government has been perpetually acting unconstitutionally; and today, States are forced to violate the U.S. Constitution and accept fiat money as tender in payments of debts.

Will the Republicans Save Us?

by Laurence M. Vance

Now that the Democrats have regained complete control of the government, many conservatives are looking to the Republicans in Congress to save us from the socialism and fascism of the Democrats. As we saw when Clinton was president, many Republicans have started talking, and some have started acting, like the conservative advocates of liberty and less government they claim to be. Will the Republicans save us?
Don’t count on it.

So why am I so pessimistic? Because I actually check how the Republicans in Congress vote instead of just listening to their free-market, limited government, and anti-Democratic rhetoric, that’s why.
