Many Montana residents are being threatened by what they see as a statist takeover of their long protected water rights, now under siege by a Democrat generated water compact and sponsored byRepublican State Senator Chaz Vincent of Libby who was against the bill before he was for it.  “The water compact is like ObamaCare on MT water,” says a Wisconsin opponent who vacations in and around Montana’s  Flathead region. He has posted a video on YouTube urging every MT resident/voter to call Democrat Governor Steve Bullock in Helena, toll free, at 1-855-318-1330 to say NO to the Flathead Water Rights takeover bill (CSKT). Senator Vincent is from a severely polluted region in Northwestern MT, an area that has been virtually taken over by governmental forces which for years heard nothing, saw nothing and said nothing about what was going on up there in the wilderness.  Perhaps the left got to Republican Senator Vincent and he had an Oprah Ah-Ha moment of liberal satori. “I’m asking (legislators) for their time to evaluate it,” says the senator of the 1,500 page Water Contract, a document so complex, so confusing, so controversial that one begins to recognize in it just how Democrats govern: by complexity, confusion, controversy! “It’s the only tribal water agreement that remains un-ratified in Montana, and it has generated strong opposition because it’s long, it’s complicated, and it deals with water rights both on and off the Flathead Reservation,” says a MT Public Radio news story. (2)

Pius IX in 1859 as a tribute to the vigorous faith of this nation raised the feast of St. Patrick which has appeared in the Roman Breviary since the Fifteenth Century, to the rank of a double. Patrick is the great patriarch of the Irish episcopate, and of Irish monachism. This monachism left its mark throughout medieval Europe wherever the Scotti planted their tents and introduced their traditions. His feast is a holy day of obligation in Ireland; there is a church dedicated to him in Rome, not far from the Via Salaria.

Proposed CSKT Compact Fun Facts - UNPERMITTED ACCESS ACROSS PRIVATE LAND

At the hearing on HB 427 (Brown), which establishes a water rights defense fund, this past Friday, March 6, in House Judiciary, the CSKT’s lead water lawyer confirmed what had recently been suspected, at least since the Compact Commission attorney alluded to the matter at the informational session held in February:  Along with giving the CSKT instream flow rights for fishing throughout western Montana, the Compact would provide the basis, without limitation, for the Tribes and their members and others to have and exercise a permanent easement across private ground to access usual and accustomed fishing places “as if it is written in the deed.”  This is unpermitted access in the western third of Montana.

Ellie Hill ask Mr. John Carter about this.  His answer is brief and to the point, ending at 3:49:45:  Where the right to fish is recognized, so is the right to unpermitted access.

 

There are a number of salient points to take from this. 

1.     The Compact, which no where explicitly mentions this matter of unpermitted access across private land, in fact lays the factual and legal foundation for such demands of a right to unpermitted access by the 4 to 5,000 members of the Tribes all over western Montana.   But wait!  There’s more!  The Compact also says, under “Persons Entitled to Use the Tribal Water Right,” (page 26, line 29 to 30):  “The Tribal Water Right may be used by the Tribes, their members, Allottees, or their lessees or assigns.”  The number of people demanding unpermitted access across private land is nearly unlimited under this language.  A robust fishing guide business could be built on this right, where “lessees or assigns” use this right to guide dudes onto and across private land without any permission.

2.     The “usual and accustomed” places open to access are completely undefined in the Compact so they are unlimited by it. 

3.     Pursuant to Treaty language, the right includes the right to construct buildings for curing fish. 

4.     Every area of Montana, therefore, where instream flow water rights for the purpose of fishing are given, or shared, with the Tribes is subject to unfettered access, without permission, by thousands of people, perhaps tens of thousands.  These areas are the Bitterroot river valley, the entire length of the Clark Fork River, the Blackfoot River, the Little Blackfoot River, the Kootenai River, the Flathead River and all three forks, Rock Creek, Flint Creek and many tributaries, lakes, wetlands, springs, and reservoirs.   No area has been excluded or cut a separate deal from this right of access and building. 

Based on a quick review of the published materials promoting this Compact, the proponents of the Compact, including state agencies, have never once mentioned that in writing that this “deal” also opens the land owned by hundreds of thousands of western Montanans to this right of access.  

It is shocking that the Farm Bureau, Montana Stockgrowers Association, and Montana Water Users Association would support such destruction of property owners’ rights. Perhaps they can be excused, temporarily, because they were ill-informed and poorly counseled.  The lawyer for Common Sense Citizens for the CSKT Compact, Ms. Hertha Lund, in fact denied that the instream flow water rights for fishing in the Compact provided this grounds for access, either out of ignorance or deceit.  You can see her say this, as confident as always, at the same link provided above if you scroll to 3:26:07 and watch until 3:27:32.   Mr. Carter had to correct her.

Whether from deceit or ignorance, the failure to candidly alert Montana to this consequence of the Compact raises serious questions, such as:

1.     Was this intended?  If so, why were we not informed?  If not, why was the issue not resolved in negotiation? 

2.     As the proponents have had to admit, the legal decisions do not provide a basis for water rights, but a right to fish, which, if found to exist by a court, means this permanent easement for access.  So why agree to give the CSKT instream water rights for fishing?  If one does that, why not as part of the bargain, limit access to the means allowed by Montana law?  Why leave it open? 

3.     For those Legislators who have voted for and supported this Compact, did you know of this consequence?  If so, why did you not make it clear?  If not, DO YOU STILL SUPPORT THIS COMPACT?

Many of us who know and respect you hope you were deceived and will now, publicly, withdraw your support for this bill. 

The standard the Water Court applies to invalidate a ratified Compact when an objection is raised by a party to a compact is that it must find “fraud, overreaching, or collusion.”  In the matter of the adjudication of existing and reserved rights to the use of water, both surface and underground, of the Crow Tribe of Indians of the State of Montana, Case No. WC-2012-06, Order Dismissing Objections, July 30, 2014, slip op. at page13. 

In light of the established fact that someone from the State of Montana Compact Commission offered up western Montana to the CSKT, rather than them demanding off-reservation rights, as admitted by a tribal attorney at the hearing on SB 262 in the Senate on February 16, [audio link here: http://montanalegislature.granicus.com/MediaPlayer.php?clip_id=15688&meta_id=97432 scroll to 4:50.], perhaps some collusion, or worse, occurred here. 

But you, Legislators, need not worry about litigation over that and neither do Montanans if you simply kill this very bad, confiscatory bill.

Last week, at Anarchapulco 2015, 

I saw Orion Martin give his 

presentation on a smartphone app 

that his company, Sidekik is 

developing. He's been told, that 

when completed, it may be the 

most complex in app history. 

Martin, an Afghanistan War Veteran 

spoke about the militarization of 

domestic police forces across the 

nation and I was struck by his 

compassionate presence and his 

open heart. We've all become so 

inured to the outrageous violence 

that goes on in our midst - and 

perpetrated by our governments, in 

our names - but during his talk, he 

made everyone in the room become 

quietly present to these daily 

atrocities.

(Later, I had conversations with him, 

including about what is happening in 

Afghanistan and his experiences were 

so hair-raising and sickening, that they 

violate the terms of service of my 

mass-emailer and Google Ads - so I 

can't even publish what he said!)

We've all seen and heard of the 

escalating police brutality and the 

hundreds of stories of police officers 

who've literally gotten away with murder. 

I even recently read a story about a 

Florida cop who's sodomized 28 young 

boys - and he's still on the job!

Well, this app is your answer to this 

growing problem. The moment you are 

pulled over or otherwise stopped by law 

enforcement, with one touch, the app will 

turn on your smartphone's video camera 

and instantly have the contents of your 

interaction recorded to a online server, 

so that even if the police officer smashes 

your phone on the ground and destroys 

it - this act will be duly recorded. 

If the officer does not smash your phone, 

your phone's GPS will give you the option 

of alerting up to 50 lawyers in your area, 

who are waiting to not only take your call 

but to *represent* you, at the scene of the 

intervention - the time of the most urgency. 

The lawyer can proceed to have a video-

streaming, recorded conversation, in your 

defense - directly with the police officer - 

because you have the right to remain 

silent - and you SHOULD remain silent.

At the time of his talk, Martin made no 

mention about what had driven him to 

create this app. I discovered on his website, 

that his good friend was beaten half to death 

by cops, and that "...After the punches, 

kicks, baton strikes, pepper spraying, 

and tasering were over, [his friend] was 

laying on the ground and still conscious. 

This is when he overheard the three 

officers talking to each other about  

their concerns that their criminal assault  

had been recorded. After ransacking

the victim's car and finding no recording 

devices the officers were now free to 

follow standard procedure and charge 

their victim with assaulting police 

officers and resisting arrest."

 

Martin was at his friend's trial and watched 

as a jury convicted his friend of the charges, 

even though the officers couldn't keep their 

stories straight and all the physical and 

circumstantial evidence showed he was 

innocent. Martin concluded that the only 

thing which could have resulted in a different 

jury decision would've been audio/video 

evidence of the officers' assault streamed 

and recorded to a remote server, to prevent 

the cops from destroying the evidence.

US$130k for the app's completion launches 

this Monday, March 9th, 2015 - and if 

successful, the app could be available as 

soon as Q3 of this year. 

I don't see it up yet on Indiegogo but I want 

to make sure that as many people know about 

this as possible.

WTF? We brought a flying drone out on our NINTH walk in the city. Even after we met with the chief of Detroit Police, and even after the entire department was made aware of our group, they still attempt to bluff us into a detainment. Dispatch was aware of our presence in the city over an hour before the police arrived.

All we exist to do is walk around cities in Michigan with our weapons exposed to initiate conversations with residents about open and concealed carry. We generally are met with overwhelming approval from residents.

Everyone will want to talk at the same time, and it will take some practice to make any real communications traffic out of what we call a pile up.  This operator has a unique situation in that every time he gets on the air he has to deal with a pile up. But this is what it will be like when we have  a  failure of civility in our country.

MONTANA in the 70’s: When the State Stood Tall for Its People and Its Lands vs. the  Self-Inflicted Injury of the Proposed CSKT Compact.

There was a time when the Montana legislature was at the forefront of environmental policy, state sovereign authority and diligent protection of the rights of Montana citizens.  Look at this interesting time line of events from 1970 through 1981 when Montana legislators were taking excellent care of their State and citizens:

1970  National Environmental Policy Act (NEPA). This federal mandate requires assessment and analysis for all significant projects affecting the environment, across the country.

1971  Montana Environmental Policy Act (MEPA). Farsighted legislators passed, 99-0, a state mandate, MEPA,  requiring assessment and analysis for all significant projects affecting the environment. MEPA stepped up the “spirit” and strength of the federal act, NEPA, and significantly expanded the public right to participate in government decisions. Perhaps now we better understand why both of these environmental mandates have been avoided at all costs. The proposed CSKT Compact is in direct violation of NEPA, MEPA, and the Administrative Procedures Act of 1946, requiring due process and a remedy for grievances against government decisions. MEPA was preparatory to the development of a new Constitution for the State of Montana, adopted in 1973.

1973 Montana State Constitution. Legislators adopted a Constitution that incorporated the intent of MEPA into Article IX of the new Constitution, and additionally provided Montanans with 35 enumerated rights in Article II, including popular sovereignty, the right of participation,  and the right of self-government.

1975  Indian Education and Self-Determination Act (Public Law 93-638) provided tribes with the right to self-government and management of their own federal funds through contracted services.  Unfortunately, many tribes ignored the critical word prefix self in self-determination and took actions toward  asserting tribal government authorities to tax and govern non-tribal persons and properties.

1981  Montana v. U.S. 450 U.S. 544.  In 1973 the Crow Tribe attempted to assert its jurisdictional authority over non-tribal lands and persons. The State of Montana argued valiantly for many years to protect Montana citizens, and obtained the ruling in Montana v. U.S. that continues to be a landmark Supreme Court case protecting citizens in Montana and across the country from tribal governance over non tribal persons and lands.

Throughout the 1970s and into the 1980s the Montana governors and state legislators were diligently protecting state sovereign authority, state natural resources and the individual rights of Montanans. So what happened between 1981 and 2015? 

The emerging coalition of a powerful triumvirate: 1) federal Executive branch over-reaching; 2) tribal government political influence and tribal government over-reaching; 3) coalitions of environmental extremists; the trendy aboriginal and United Nations movement, and the globalists promoting Agenda 21. All of these folks are on the same page, singing from the same hymnal and absolutely dedicated to the demise of State sovereignty, citizen and property rights. This cumulative political and financial power has had oppressive and intimidating success among elected officials at every level of state government and academia in Montana. The 2015 Montana State Legislature does not remotely resemble the Montana Legislature of the 1970s, when the State was acting like a State and damn proud of it.

What will be the end result of the CSKT Compact if Montana's legislators breathe life into this legislative Beast?  Look again at the policies and laws noted in the time line above.  The CSKT Compact will render irrelevant the U.S. Constitution, the Montana Constitution, the National Environmental Policy Act, the Montana Environmental Policy Act, and this is just openers. Current state legislators passing the Compact will ensure their ongoing and future irrelevancy as elected officials of a state intentionally enfeebled by the CSKT Compact. Oaths of office and the Pledge of Allegiance are now just meaningless, irrelevant rituals. One of the finest State Constitutions in the country, Montana’s 1973 Constitution becomes toilet paper.

Another irony:  Passage of the Compact will also overturn hard-fought protections from tribal governance over non-members in 1981 Supreme Court case of Montana v. U.S. for Montana citizens; however,  the rest of the country will remain protected by this Landmark ruling of the High Court because the ruling protects citizens from tribal governance absent their individual consent.  The Compact legislatively removes individual citizen consent for some 350,000 Montana citizens in 11 counties that will be subject to tribal government control of their water, their water rates, and water-dependent land use.

The Compact is not just about water. It is now about the Rule of Law as well. Our federal and state Constitutions matter, or they don't. Our federal and state environmental mandates matter, or they don't. Supreme Court rulings matter or they don't. Exactly what does matter to current legislators and an entire cadre of well-paid Montana state attorneys? It certainly does not seem to be to uphold the Rule of Law in the State of Montana. The once youthful and muscle-bound State of Montana is voluntarily surrendering its Statehood to Assisted Living in perpetuity, to be governed by tribes, the federal government and International organizations intent on destroying State authorities, property rights and the rights of the Popular Sovereignty of each and every citizen. Montana is already buckling at the knees; the proposed CSKT Compact begins the process of turning off the State’s life support as a State. The battle then goes to all of the other Western States.

One more sad irony: There is within the rule of law the Doctrine of Parens Patriae. This is a legal doctrine wherein a State within its sovereign capacity may provide protection, and may even sue on behalf of, citizens unable to care for themselves. The proposed Compact will render tribal and non-tribal landowners, 11 counties and their municipalities, and some 350,000 Montanans needing water for the homes and businesses, hard pressed to pay high water rates, or take care of themselves in the future. Do you suppose your current or future Governors and State Legislator will step in to help them?

A victorious CSKT Compact opens the door for the federal government, tribal governments and globalists to fundamentally transform Montana to something unlike the proud State that existed in the 1970s. Montana legislators passing this Compact may just as well turn off the lights in the Helena Capitol because the CSKT Compact is a fatal, self-inflicted injury to State sovereignty and all of Montana's waters. Legislators voting for the Proposed CSKT Compact are assuring their future as useful idiots to federal, tribal and international influence.

1977 Mercury Marquis price reduced again

I have reduced the price on this very nice Mercury Marquis to $3900.

 

I was asked how this car would stand up to an EMP pulse. My answer is that there are only two parts that would need to be replaced

if an EMP ever did occur and it was powerful enough to damage those parts.  Chances are an EMP would'nt effect this but here you go.

 

There are no computers of any kind in this car. The only electronic components are the ignition module and the pickup module in the distributor.

 

The module (premium version) from NAPA is model TP40 and costs 61.49

The pickup module (premium version) is MP700   31.49

 

Take these parts and put them in a metal box (farady cage) in your closet and you are good to go.

Montana, have you learned NOTHING from the Bundy Ranch standoff?

From talking about the CSKT water grab with fellow Montanans around the state it is clear to me that they consider that bill to be unconstitutional and unlawful.

The feeling I get is that there are quite a number of people in our state that will not stand by and watch our water and land be stolen by out of control federal agents using the tribes as a vehicle.  They also know that the agenda of putting the water under federal control is just one part of the UN Agenda 21. 

They also know that the US Supreme Court has said all laws that are unconstitutional are null and void from their inception as if they had never been written.

"All laws which are repugnant to the Constitution are null and void." Marbury Vs. Madison, 5 US (2 Cranch) 137, 174, 176, (1803). "Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them." Miranda Vs. Arizona, 384 US 436 p. 491. " An unconstitutional act is not law; it confers no rights; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed." People like Chas Vincent are dreaming if they think the people in Montana are just going to lay down and be run over by this tyranny and watch their water be stolen right out from under their nose, by a pack of law (constitution) breaking wolves in sheep's clothing (legislators) who are trying to authorize plunder under the color of law.

Water is life. Without water Montana's economy, which is bad enough already, will certainly suffer, and all those families who have worked for decades to accumulate those water rights and prove ongoing usage in order to keep those water rights at great expense for the infrastructure for that water will be in danger of not being able to produce enough products to sustain their businesses and families.  This is nothing less than outright theft.

Montana is hurting bad enough already. IT'S TIME TO GET OUT OF STATE INTERESTS OUT OF OUR STATE especially the communist federal government !

Tell your legislators to vote against SB 262

If we can't convince the legislature to kill this, I WOULD NOT RECOMMEND THAT THE PROPONENTS BE PRESENT WHEN THE FIRST HEADGATE IS SHUT DOWN AT THE FIRST RANCH THEY TRY TO STOP FROM IRRIGATING UNDER THIS NEW FEDERAL TAKEOVER.

Have these people learned NOTHING from the Bundy Ranch standoff?  The line in the sand was already drawn.
Killing SB262  and passing  HB583 are two steps in the right direction toward freedom in Montana.

It is surprising that MHRN still uses the lame tactic of attacking this bill by associating the proponents with "anti-government militias". This bill was not written by "anti-government militias", but instead was written by good neighbors who have bothered to look into just what G.H.W. Bush signed this nation onto in 1992 when the United Nations introduced Agenda-21.

Former Madison County Commissioner Dan Happel is a Montana rancher who has done extensive research into Agenda-21. Any reader here who doubts his knowledge, which is derived from literally years of research, need only look into the matter oneself.

MHRN has a hidden agenda of its own, which is to deprive Montanans of their Constitutionally-protected "unalienable rights" in the name of socializing all Montanans as "world citizens". To prove my point, I offer a Resolution by the Republican National Committee itself, which resolved in 2012 to expose the wickedness of Agenda-21 to all Americans. So we clearly see that MHRN's Rachel Carroll Revas has her own Agenda, and would try to shift focus from the seriousness of this bill in its effort to protect all Montanans by associating the bill with "anti-government militias". What a cheap shot!

On the other hand, former County Commissioner Dan Happel has only this State's Constitution and our nation's Constitution at heart, and is trying to reveal something very sinister as the ngo's continue to work through the EPA, FEMA, BLM, USFS, and other non-elected Federal agencies to erode our freedoms as Montanans.

In closing, I would love to hear a logical explanation why this news outlet chose the pictures it employed in composing the above video as reportage on this bill. It strikes me as fairly blatant and disruptive to associate such imagery with purportedly objective reportage of news affecting all Montanans.
