Dear Lincoln County Planning Board Members and County Commissioners,
I am writing in opposition of the proposed zoning district overlay for the Turtle Lake area in Lincoln County near Eureka. While I live in Whitefish, I am part of an ownership trust of my mother’s lot GG, and my brother owns, lives and farms on the lot next door, both on the lake. I spend about twenty weekends a year there. I am also a professional land use planner with twenty years experience in the public and private sector, most of those years spent writing and enforcing zoning ordinances in Alaska and Montana. I believe this proposal is inconsistent with the Lincoln County Growth Policy, which I will outline below. I will also include an item by item analysis of the text of the proposed zoning document, which includes comments and concerns on many items which from my experience are inconsistent or would be very difficult to enforce.
Some well meaning neighbors have put together a draft zoning overlay district for the Turtle Lake area. The zoning, which states its primary purpose is to curb people living in RV’s, also attempts to impose some of the owner’s existing covenants on lot owners that currently have no covenants. Establishing covenants for a new subdivision is a method often used to protect property values and increase the value of undeveloped lots by setting ground rules for development. However, trying to impose covenant-like rules on neighbors who have small existing lots with no covenants that don’t want them infringes on property rights and is down-right un-neighborly.
As a planner, I support good planning and believe zoning can be an effective tool for communities to protect property values and amenities while minimizing neighborhood conflicts. However, zoning documents are often challenged. They need to be well written, have clear objectives, be concise, and they must implement the goals of adopted long range plans. If you are creating and imposing zoning from scratch in a rural county like Lincoln where there currently isn’t much zoning, it’s a pretty big deal. Zoning regulations shouldn’t be slipped through over the holidays in the winter when the people most affected can’t be there to protest. That’s not very fair.
Zoning should to be accomplished through a broader, community-wide discussion of goals and objectives for various types of land uses and as a direct implementation of an adopted Growth Policy and an adopted area plan which includes specific land use goals for neighborhoods. This proposed zoning district is not based on a long range plan. It is poorly written, over-reaching, difficult to enforce, and most importantly, and inconsistent with the zoning chapter of Lincoln County’s own Growth Policy.
Montana Law and the Growth Policy
In order to enact zoning in the State of Montana, State Statute 76 says that all zoning regulations adopted must be consistent with an adopted County Growth Policy.

(1) Zoning regulations must be: (a) made in accordance with the growth policy


In response to the article on proposed zoning…

  Emerson would be upset to know this zoning document would forbid him from building his rustic cabin on Walden’s pond. Ms. James is quite correct in stating that this came about as a way for the lots on the Turtle estates second subdivision to enforce their covenants on the first subdivision owners(Lots A,B,C,D) and actually the rest of the owners on Turtle Lake. By creating a zoning district this places enforcement directly on the county and thus the tax payers of Lincoln County. If this document was only about RV’s and lot densities, it would read, minimum lot sizes for divisions and minimum square footage for single family dwellings, period. This document goes far beyond their supposed intent and is a direct attack on property rights, small businesses and agriculture in Lincoln County.  In order to impose this mob rule (60%) and poorly written zoning on their neighbors, the lots in the first subdivision had to be gerrymandered eliminating lots A and B (the founding lots) from a vote or participation. They may argue that they do not have lake front, but neither does lot AA on their side. As a third generation Montanan and third generation farmer I have some serious problems with their zoning regulations. My grandparents made it through the great depression (Highwood Mt.) by having a subsistence farm as opposed to a citified “hobby farm” as proposed.” 1 large hoofed and 2 small hoofed animals per acre, all animals fenced and or caged, no pigs, no cows, no dairy”. As a retired licensed and insured building contractor in Mt. I’m wondering who is going to enforce the building codes proposed, but mostly, who is going to pay for this building inspector ? (That’s right tax payers of Lincoln county! ) In the article I was quoted as saying I was going to build an earthship home when actually I used this as an example of a 15,000 sq ft mansion built by Denis Weaver in Colorado with no cement foundation. What about sono tubes/post and pole foundations? Or slab on grade shops? Or post and pole barns…etc…Having built multi - million dollar alternative energy mansions in the Flathead for 20 years, I find their proposed ticky tacky stick framed vinyl clad low efficiency dwellings to be an affront to the new alternative green technologies and detrimental  to my property values and the environment. As to businesses, no manufacturing, does this include signs? Wood products ? Nope just hotrods, farms, hmmm doesn’t sound personal, just like chain sawing down my solar greenhouse, attempting to burn me out or desecrating my pet graves…OK…now for legal control paid for by my good friends and other neighbors who pay taxes and live here or moved here to get away from this same BS elsewhere. Just wait till zoning comes for you!!!

DICK ACT of 1902 CAN'T BE REPEALED (GUN CONTROL FORBIDDEN)

The Dick Act of 1902 also known as the Efficiency of Militia Bill H.R. 11654, of June 28, 1902 invalidates all so-called gun-control laws. It also divides the militia into three distinct and separate entities.

The three classes H.R. 11654 provides for are the organized militia, henceforth known as the National Guard of the State, Territory and District of Columbia, the unorganized militia and the regular army. The militia encompasses every able-bodied male between the ages of 18 and 45. All members of the unorganized militia have the absolute personal right and 2nd Amendment right to keep and bear arms of any type, and as many as they can afford to buy.

The Dick Act of 1902 cannot be repealed; to do so would violate bills of attainder and ex post facto laws which would be yet another gross violation of the U.S. Constitution and the Bill of Rights. The President of the United States has zero authority without violating the Constitution to call the National Guard to serve outside of their State borders.

The National Guard Militia can only be required by the National Government for limited purposes specified in the Constitution (to uphold the laws of the Union; to suppress insurrection and repel invasion). These are the only purposes for which the General Government can call upon the National Guard.

Attorney General Wickersham advised President Taft, "the Organized Militia (the National Guard) can not be employed for offensive warfare outside the limits of the United States."

The Honorable William Gordon, in a speech to the House on Thursday, October 4, 1917, proved that the action of President Wilson in ordering the Organized Militia (the National Guard) to fight a war in Europe was so blatantly unconstitutional that he felt Wilson ought to have been impeached.

During the war with England an attempt was made by Congress to pass a bill authorizing the president to draft 100,000 men between the ages of 18 and 45 to invade enemy territory, Canada. The bill was defeated in the House by Daniel Webster on the precise point that Congress had no such power over the militia as to authorize it to empower the President to draft them into the regular army and send them out of the country.

The fact is that the President has no constitutional right, under any circumstances, to draft men from the militia to fight outside the borders of the USA, and not even beyond the borders of their respective states. Today, we have a constitutional LAW which still stands in waiting for the legislators to obey the Constitution which they swore an oath to uphold.

Charles Hughes of the American Bar Association (ABA) made a speech which is contained in the Appendix to Congressional Record, House, September 10, 1917, pages 6836-6840 which states: "The militia, within the meaning of these provisions of the Constitution is distinct from the Army of the United States." In these pages we also find a statement made by Daniel Webster, "that the great principle of the Constitution on that subject is that the militia is the militia of the States and of the General Government; and thus being the militia of the States, there is no part of the Constitution worded with greater care and with more scrupulous jealousy than that which grants and limits the power of Congress over it."

"This limitation upon the power to raise and support armies clearly establishes the intent and purpose of the framers of the Constitution to limit the power to raise and maintain a standing army to voluntary enlistment, because if the unlimited power to draft and conscript was intended to be conferred, it would have been a useless and puerile thing to limit the use of money for that purpose. (www.RemnantNewspaper.com) Tough to swallow, isn’t it!  But did we really think we could somehow vote our way out of this—with homosexual "marriage" having become the law of the land and the slain bodies of millions of aborted babies clogging the sewers of American cities and consciences?  All that was needed for us to be redeemed was another election? Please! Ideas have consequences—and so do the crime of infanticide and the other sins that cry to heaven for vengeance. Barack Obama is not the problem, by the way. We are!  Abortion is. Public schools are. A rotting pop culture is. Modernism in the Catholic Church is. Divorce and homosexual "marriage" are. Obama has been reelected because America, like any nation, will always get the leaders she richly deserves.  We told God to go to hell a long time ago, and God is merely allowing us to see what life is like without Him.  So lead on, Mr. Obama!  Thou shouldst not have any power against us, unless it were given thee from above. Therefore, he that hath delivered us to thee, hath the greater sin. We are Christians, and our help is in the name of the Lord—not electoral politics. So, let's keep this all in perspective.  Out of sheer desperation, most of us threw our hats in the ring for a Mormon, big government, sometimes pro-life, moderately pro-gay rights candidate who is conservative by comparison only.  Even by John F. Kennedy's standards, Mitt Romney, though no doubt well meaning, is a rabid liberal.  In other words, the GOP bet the pot on a moderate conservative, again...and lost big, again.  They took our votes for granted, again, by downplaying the rather embarrassing social issues in favor of the ever-sophisticated pocketbook issues. Once again, it didn’t pay off, so perhaps they will have learned their lesson the next time around...if, in fact, there is a next time after the insufferable McCain and Mormon Romney fiascoes. But there is a silver lining in all of this for those willing to see it. Folks in the real world are obviously fed up with the charade and will finally be absolutely united against an evil that would have remained entrenched inside the Beltway no matter who won this election. Conservative Catholics, traditional Catholics, pro-family Protestants, pro-lifers, pro-homeschooling advocates will all be solidly united against the White House for the next four years—and this is always a good thing. America's slide into total hedonism may well have been checked with the 53  percent having now come to realize the full extent of our national illness. This election has made it abundantly obvious to millions that vast numbers of their compatriots have simply lost any semblance of their God-given sense of moral equilibrium--a sobering fact that will force those who still have a moral pulse to realize they're standing in knee-deep water that is rapidly rising and that it's time for them to seek higher ground.  In other words, the party is finally over. This is a golden opportunity for us, then—not to accuse Obama for being a closet Muslim or whatever else—but rather to encourage Americans to come out of their respective closets and to become Christian again. The human element of the Catholic Church has an eleventh-hour opportunity to abandon the failed policies of Modernism that have plagued the Church for too long, before the Church in America will be crushed beneath the heels of militant atheists. Moderate, jovial, doctrine-less bishops lost big tonight. Cardinal Dolan, Governor Chris Christie—what’s the difference! Who cares! We've had enough! An awakening took place tonight, and it means that faithful, traditionalist, God-fearing Americans can finally begin to move towards authentic restoration of everything that matters in this life—that which Americans once held sacred, good, honorable and noble because it is based on love of God, His law, Christian culture, tradition and the family After all, it's not as if all things were exactly rosy back in the winning days of the GOP.  Who could forget the Stalin-esque Patriot Act, for example.  Or Donald Rumsfeld’s infamous salivating over “shock and awe” in Baghdad.   Or how about that precedent-setting moment when "conservative" Secretary of State Condi Rice swore in homosexual Mark Dybul as President Bush’s Global AIDS Coordinator, while First Lady Laura Bush looked on approvingly, along with Dybul’s gay partner, Jason?   And then there were those pro-abortion First Ladies, you remember them—Nancy, Barbara and Laura.  And Congressman Mark Foley and his pages, remember that “conservative”?  By the way, was GOP “conservative” Arnold Schwarzenegger "one of ours" when he was conducting homosexual marriages inside the governor’s mansion in California?  I’ll never forget the pain of division between family members and other pro-lifers who sincerely believed we were all obligated before God to go along with every dingbat initiative out of the White House must because our president said he was "prolife" and doing God’s holy work. Again, let us not lose perspective.  In many ways, Mitt Romney would have taken us back to the good old days, which, let’s face it, weren’t all that. Yes, tonight the champions of outright atheism, abortion, and the destruction of the family narrowly won reelection; but they didn't win a mandate and they will certainly be met with resistance.  Millions of us, in fact, will unite against their Godless agenda, promising gigantic gridlock which may well prove to be the last, best hope for America. So, did we have a horse in this race?  I don’t know...probably not. I think most of us were just making the best of a desperate situation by buying some time and praying America would wake up in the meantime. But if waking America from her half-century slumber was the objective, perhaps that mission was accomplished when Ohio was declared for Barak Obama. For the next four years at least, millions of Americans will stand fast against the Godless polices of Washington, D.C.—policies which, again, let’s face it, on the issues that matter most to the soul of our country would have changed only minimally had the well-meaning Mormon been victorious. So, to recap: We lost a race in which we really didn’t have a pony.  But, as a result of that defeat, millions of Americans have had their blinders removed and now know exactly where they stand. They have, it would seem, woken up at last. Obama represents our chastisement, perhaps, but not our conqueror. His victory may well lead to our redemption, in fact, both as Catholics and as Americans.  Four more years of Obama may mean that America will have to suffer, but perhaps she will also begin to find her soul again… and her knees. Then Americans will actually have a chance to be truly free, after all. God writes straight with crooked lines, and if America is to be humbled and brought to her knees, perhaps she will be redeemed in the process. For this we hope and pray, even as we vow to fight against the reelected regime and to never surrender the old Faith of our Fathers—come what may. Come out of her, my people, that ye be not partakers of her sins, and that ye receive not of her plagues. Rev. 18:4

What next? How do we proceed now?

I will only add a few thoughts to the letter below by Michael J. Kelly from Brussels Belgium.

1. A country always gets the government it deserves.

2. The vast majority of the American people don't deserve to be free because they squander that freedom on immorality.

3. The country is going broke and will crash on their watch.

4. They will drag us down with them, but in the end our Lord Jesus Christ will intervene.

5. The only way to save America is to get on our knees and humble ourselves before God, acknowledge our sins, beg His forgiveness, and then get up and work like it is all up to us to save the country by setting a good example of moral living and true Christian Charity, and by trusting in Him to do the heavy lifting that we are not capable of on our own. Remember Jonah and Nineve, and what happened when those people repented of their sins.

That is not the end of what we should do, but it's a great start. There will be more on my blog in a few days about this line of thought.

There is NO way mathematically to save the US Dollar (Federal Reserve Note) even if we wanted to. It must be replaced with something of real value.

There is NO way politically to save our Constitution since we have been under maritime law (law of nations) and roman civil law (all the courts use it) and the uniform commercial code for decades. There are NO common law courts left in America, which means there is NO justice in any court in the land.

Read the 7th Amendment to the US Constitution and then tell me we have any real justice in Amerika.

Article VII:  "In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law."

We are coming to the end of civil order. Order from now on will be given out at the barrel of a gun by government terrorists, and the police state.

Already within 24 hours of the election word is out that the UN is starting up the gun grab, and Obama is pushing it enthusiastically.

This election is very much in doubt as there have been many reports of election fraud in several states. People in Ohio came to the polls to find that someone had already voted in their name on an early ballot. This happened several times. Then there were reports of many dead people voting in California. How can we have true elections using these methods? It's impossible. All elections should be done by paper ballots and counted by hand, with a paper trail of the vote. Until then there will never be a real free election ever again in the US. Then there is the problem of the two branches of the same big government party called Republicrats, and Demicans.  The way the GOP stomped on Ron Paul is absolutely unforgiveable. It was dirty rotten political criminality at it's highest.

It's the reason I resigned as State Committeman from Lincoln County and also from the Republican Party after several years of trying to correct their thinkng from the inside. There is just no way. I know they will never change. The Republicans are more interested in preserving their power than in restoring freedom in America.  This last election proves it. The chairman of the Republican Party in Montana says that Dan Cox was a spoiler. No, the Republican Party split their own party and spoiled their chances at winning when they refused to support Ron Paul, and the US Constitution. They had better get used to losing if they are going to continue with that attitude. They will never win another election unless they get back to the principles outlined by the founders of our Country.

In any case, now the focus needs to be on preparing for the inevitable crash of the currency, and some real hard times in our country. The only real chance we have is to stay out of it's way as much as possible. To that end we will continue attending the gun shows with our preparedness products, such as silver, radio gear, fuel preservative and conditioner, and portable solar power products. At some point I am sure we will not be able to do that. I am hoping we have a little time left but won't be placing any bets in that regard.  My next show is Nov 30, to Dec. 2nd in Kalispell at the fairgrounds, then on the following weekend at the fairgrounds in Bozeman for three days. That will conclude my schedule for this year and until Feb. of 2013 in Butte. That make 21 gun shows in 2012.

I think the following says it all!

The biggest loss in yesterdays election was the rule of law.A loss brought to the nation by the political party of lawyers.In the next four years at least two Supreme Court Justices will retire and will be replaced by lawyers appointed by a liberal administration changing the balance of power for that will reshape the very foundation of the country.We now have a minority in the Court that does not believe in our Constitution as a foundational document. Ruth Bader Ginsberg in February of this year when commenting on Egypt''s development of a constitution for its new government said: "I would not look to the U.S. Constitution, if I were drafting a constitution in the year 2012," Ginsburg said in an interview on Al Hayat television. "I might look at the constitution of South Africa. This is a radical view of the very fiber of the foundation of the country.Add more of this influence to the Court and ur country will not survive.

This new era of leadership is in the hands of a party that attempted to remove the word and the concept of GOD and support for Israel from its basic arty Platform at its National Convention.Supported by a President who announced to the world is a speech delivered in Cairo in 2009 that America as no longer a Christian country. He said that at a time when 73% of Americans identify themselves as Christians. He then went on to bow to the king of Saudi Arabia.

Our electorate has chosen to be led by a radical Progressive who compares American Exceptionalism to Greek Exceptionalism.A person who has no belief in the free spirit of the American Individual's personal desire and responsibility to create essential improvement of society through personal growth in a Capitalist financial system.A president who genuinely believes that our society must be managed by an elitist group of bureaucrats in our central government.

We, our electorate, in our adoration of celebrity," have expressed admiration for people of no substance.They worship perceived cool and admire those the press defines as good. What we are left with is an element of those who have discovered power and from the seat of government have created an industry that has defined a career of politics thus creating a class of elites that buy their station in society with gifts to the electorate from the public treasury.

So, America, you have done it.In your desire to get your life purchased for you by the politician you perceive will send you security, will give you personal financial stability from the public treasury, you have removed all the strength from very foundation upon which you stand.The financial base those politicians use to buy your vote is no longer funded from the center of our country; it is borrowed money from other societies and their base wealth.We no longer own our own destiny.

We are done.We have crossed the tipping point.I can say to all of my relatives that I lived my youth in a time that will be remembered as the greatest point, the pinnacle, the zenith of our Western Civilization.This was a time of prosperity that was purchased for my generation by our parents to make a better life for us than they had experienced.Some of our parents even gave their lives for us, so that we could prosper and understand the promise of America.My own father is buried in Belgium near where he lost his life at age 31 in December of 1944.

The result of last nights election has been brought upon us by a century, yes, a hundred years of assault on freedom by a Progressive Ideology that has fed itself from the inside of our own body.In the next four years, we will see a steady decline in our environments, our communities, our lifestyle, our dollar, the value of everything we have worked for, the vary freedoms we have sacrificed for and at the end of that period, the voting majority of the population will be so dependent on free stuff from the central government that recovery of the American Exceptionalism that made this the best place on Earth will be far beyond the reach of the American Citizenry.

We are no longer the America we have known and loved, we are toast!
