How to Read "Theft by Deception"

There is a wonderful expose that has been kicking around the patriot community since 2010, called "Theft by Deception".  The Author did a great job of painting the framework of The Great Fraud -- the problem with it is that the people reading it don't have the background to interpret it correctly. 

So today, we are going to take a direct quote from "Theft by Deception" and I am going to annotate it, so that you can read it and know who is doing what and make sense of what is being said. 

Start by realizing that wherever you see the words "the United States" the Author is talking about a foreign commercial corporation which is a Subcontractor of our American Government.  

Wherever you see the words "the United States of America" the Author is talking about another foreign commercial corporation Subcontractor of our American Government, which sometimes acts as a rival of "the United States" Incorporated.

Since the 1870's both these foreign Service Vendors have been operating as incorporated entities, and their business has been overseen by the members of the District (Territorial) Congress acting in two separate capacities.  

As the District Congress, what you are familiar with as "Congress" today, they oversee the District of Columbia Territorial Government, organized as a commercial corporation in the business of providing government services-- that is, the United States of America (Incorporated).

As the Municipal Congress, the same members put on a different hat and serve as the plenary government of Washington, DC, and serve the interests of a different commercial corporation: the United States (Incorporated).  

Throughout the following except from "Theft by Deception" the entities being described are these corporations and actions undertaken by Members of Congress acting as their respective Boards of Directors.

Always remember that the actual American Government is unincorporated.  Also remember that only incorporated entities can go bankrupt.  So our American Government is not and never has been bankrupted, sold to anyone, or merged with any other corporation at all.  

All that talk about bankruptcy that has been the focus of so much concern, directly impacts our foreign Service Providers -- not us.  

Even though I disapprove of using all capital script, I am going to use it today to distinguish between the words of the actual quoted material from "Theft by Deception" and my annotations which  appear in all capital text below: 

Quote from "Theft by Deception"

"On the night of December 23, 1913 the United States Congress passed the Federal Reserve Act and thereby committed the greatest act of TREASON in history." [NOTE: THE GROUP TAKING THIS ACTION IS THE MUNICIPAL CORPORATION BOARD OF DIRECTORS.] 

"It surrendered this nation's sovereignty and sold the American people into slavery to a cabal of arch-charlatan international bankers who proceeded to plunder, bankrupt, and conquer this nation with a money swindle." [NOTE: THEY DIDN'T HAVE ANY POWER TO "SURRENDER THIS NATION'S SOVEREIGNTY" -- THIS WAS AN IN-HOUSE BUSINESS SWINDLE INVOLVING THE ADMINISTRATION OF THE MUNICIPAL CORPORATION AND ITS "CITIZENRY" -- FEDERAL CIVIL SERVICE EMPLOYEES AND THEIR DEPENDENTS --NOT RANK AND FILE AMERICANS.]

"The "money" the banks issue is merely bookkeeping entries. It costs them nothing and is not backed by their wealth, efforts, property, or risk. It is not redeemable except in more debt paper. The Federal Reserve Act forced us to pay compound interest on thin air. We now use worthless "notes" backed by our own credit that we cannot own and are made subject to compelled performance for the "privilege".  [NOTE: THIS IS A GOOD EXPLANATION OF WHAT THE FEDERAL RESERVE ACT PROMOTED AS A FRAUD SCHEME, BUT WE ARE NOT OBLIGATED TO IT. THIS SWINDLE WAS ADOPTED BY A COMMERCIAL CORPORATION AND APPLIES ONLY TO ITS OWN "CITIZENRY" -- IT'S EMPLOYEES AND DEPENDENTS.]

"From 1913 until 1933, the United States paid the "interest" with more and more gold. [ACTING IN BREACH OF TRUST, THE MUNICIPAL CORPORATION 'BORROWED" OUR GOLD; HAD NONE OF THEIR OWN.] The structured inevitability soon transpired: the Treasury was empty, the debt was greater than ever, and the United States [THE CORPORATION] declared bankruptcy. 

[NOTE: THEY HOPED THAT BY DECLARING BANKRUPTCY THEY COULD AVOID THE NECESSITY OF PAYING BACK OUR GOLD -- AND IN FACT, THEY DUMPED THE COST OF THEIR BANKRUPTCY ON US, BUT THEIR FOREIGN PRINCIPALS REMAIN RESPONSIBLE FOR THIS CIRCUMSTANCE AND DEBT TO THIS DAY.] 

"In exchange for using notes belonging to bankers who create them out of nothing on our own credit, we are forced to repay in substance (labor, property, land, businesses, resources, life in ever-increasing amounts. This may have been the greatest heist and fraud of all time." 

[IT IS INDEED A THEFT AND FRAUD, WHICH THEY FOISTED OFF ON THE AMERICAN PEOPLE IN BREACH OF TRUST VIA CRIMES OF PERSONAGE, CLAIMING THAT WE WERE ALL PART OF THEIR MUNICIPAL "CITIZENRY" WHEN WE ARE NOT.]

"When a government goes bankrupt, [THEIR CORPORATE GOVERNMENT, NOT OURS]  it loses its sovereignty. In 1933 the United States [MUNICIPAL CORPORATION] declared bankruptcy, as expressed in Roosevelt's Executive Orders 6073, 6102, 6111, and 6260, House Joint Resolution 192 of June 5, 1933, confirmed in Perry v. United States, (1935) 294 U.S. 330-381, 79 L.Ed 912, as well as 31 USC 5112, 5119, and 12 USC 95A." 

"The bankrupt United States [CORPORATION]went into receivership, reorganized in favor of 115 creditors and new owners. In 1913, Congress turned over America... lock, stock and barrel to a handful of criminals whose avowed intent from the beginning was to plunder, bankrupt, conquer, and enslave the people of the United States of America and eliminate this nation from the face of the earth. [NOT "AMERICA"-- THE UNITED STATES CORPORATION ONLY.] The goal was, and is, to absorb America into a one-world private commercial government, a "New World Order."


"On March 9, 1933 President Roosevelt called for the passing of The WAR POWERS ACT TITLE 12 USC. Section 95 (a) and 95 (b). This act declared all United States Citizens [THAT IS, THE CITIZENRY OF THE OTHER COMMERCIAL CORPORATION, THE DISTRICT SERVICE PROVIDER]  to be the enemy of the United States Government, and placed us [THEM] under permanent Emergency Rule, bypassing Constitutional constraints on government. 'With the Erie R.R. v Tompkins case of 1938, the Supreme Court confirmed their success." [ALL THIS CASE REALLY CONFIRMS IS THAT THE FEDERAL SUBCONTRACTORS DO NOT HAVE ACCESS TO "GENERAL COMMON LAW" ---WHAT THEY LEFT OUT IS THAT THEY DO HAVE ACCESS TO A FORM OF MILITARY COMMON LAW.] 

"We are now in an international private commercial jurisdiction in colorable admiralty-maritime under the Law Merchant." [NO, WE AREN'T -- THEY ARE, AND THEY ARE TREATING US 'AS IF' WE WERE PART OF THEIR UNFORTUNATE CITIZENRY WHEN WE ARE NOT.] 

"We have been conned and betrayed out of our sovereignty, rights, property, freedom, common law, Article III Courts, and The Bill of Rights has been statutized into "civil rights" in commerce. You have destroyed the Republic. America has been stolen." [NOT EXACTLY. THE FEDERAL REPUBLIC WAS RENDERED INOPERABLE IN 1860, SO NO NEWS THERE. THE FEDERATION OF STATES RECEIVED BACK THE REPUBLIC'S DELEGATED POWERS BY OPERATION OF LAW.  NO PART OF OUR GOVERNMENT WAS "STOLEN" BY THESE CON ARTISTS, INSTEAD, WE HAVE BEEN MISREPRESENTED AS MUNICIPAL CITIZENS, AND AS SUCH SUBJECTED TO THEIR LAW. IT REMAINS FOR US TO REPUDIATE ANY CLAIM OF MUNICIPAL CITIZENSHIP.]

As you can see, the situation and position of the actual Americans is very, very different from the situation for Federal Civil Servants who work for and are dependent upon "the United States, Incorporated", but if you were to read this without the specialized knowledge contained in the annotations, you would be left with the idea that we were all bound to the same circumstance as the Federal Civil Servants. 

That's what the Perpetrators always wanted you to think and assume, so that they could continue to play their deceptive games and go on plundering and pillaging the General Populace --- not just Federal Civil Servants who make up the "citizenry" of the Municipal Corporation. 

It remains for us to gain the skill needed to read material like "Theft by Deception" from our own point of view -- not theirs. And asset our standing and status as Americans who are not "members of the city or the district".

The war on freedom

The current earth’s population of humans is estimated to be approximately 8 billion souls.

And within that number not a single one or group of ones has the right to initiate force, threat of force or fraud against another’s life, freedom and property.

Force, retaliatory force is justified only in defense against the one’s initiating force, threat of force or fraud.

No exceptions exist.

This premise applies irrespective if one claims to be a group of voters, tribes, governments, corporations, etc. One cannot grant or vote a right to another or groups (irrespective of the numbers), that they themselves do not have.

The nature of life requires humans to create and produce the values necessary to sustain one’s life and as value creators our relationship to each other is the voluntary fair exchange of values.

Value Creator’s life requires the freedom to create and not be harmed by another.

Survival pressure dictated that men form societies with the division of labor concept wherein one could trade the products of his/her creation thus becoming more efficient then if one had to produce all the values necessary to sustain one’s life.

For these societies to peacefully function and prosper men had to operate on the basis of honesty, fairness and accountability, allowing all to be more efficient and productive while providing more values to exchange and accumulate.

Creating prosperity through value creation requires freedom and honesty, as opposed to the value destruction of the external authority cult we have today that’s based on fraud.

Throughout history, attempts have been made to protect individual freedom through concepts of justice and law. Some good examples have been the Magna Carta, Declaration of Independence and the Bill of Rights, the latter being resisted by the federalist while debating ratification of the American Constitution as being unnecessary due to the fact that the proposed constitution only granted “few and defined” enumerated powers in a federal government (See: Federalist and anti-federalist ratification debates).

And look at this fraudulent corporate monstrosity we are currently tolerating.

Long before the Magna Carta, war of independence the bill of rights, it has always been immoral/wrong for conscious man to initiate force, threat of force and fraud against his fellow man.

Let’s be clear, nowhere during man’s history did any man/woman gain the right or permission to be an authority over another (parents have limited authority over their dependent children).

The American Bill of Rights (Dec. 15, 1791) with its 10 articles codified this fact in law. Yet today we see those article’s being infringed upon repeatedly.

You can see how vigorously the 2nd Article is being infringed. The 2nd article is codified law with its language recognizing the natural right to defense with arms and the Americans lawful remedy if and when the state of freedom was not being preserved.

Men who attempt to gain the unearned and undeserved insist on placing themselves in positions of perceived power as your authority and plan to get away with their crimes. They have used the ill-gotten gains derived from that power to remove your common law courts and means of redress, justice.

They spray you from the skies above with chemical concoctions, they have monopolized the control and production of the products we have become dependent upon, they contaminate your food and body care products, they have distorted and monopolized the information sources, the education sources, food production, medicine and the sciences.

Disinformation and propaganda are the norm. All in an attempt to control your resources, health, perception of reality and also to retard the evolution of your consciousness, for if only you could see through the fraud, there goes their (the self-proclaimed ruling class) way of life.

Take for example the insistence on convincing you that their motive and role is to provide for your general welfare and safety, just look what that has brought us with untold fraudulent wars and death, the war on/of terror and the destructive war on drugs.

While I do not condone the irrationality and destructive nature of drug abuse, there is great evidence that the drug war is merely serving as a means to increase police state powers while infringing on our freedoms. Many have suggested evidence that the drug cartels are being partnered and managed by government agencies (see one example in the San Jose Mercury News The series, DARK ALLIANCE: THE STORY BEHIND THE CRACK EXPLOSION).

In my small rural community of approx. 500 they have installed a license plate reader/camera in the guise of the war on drugs making us all collateral damage of this warrantless surveillance. While in other communities they use the war on drugs to rationalize roadside body cavity searches, no knock raids, civil asset forfeitures and many other infringements all in the guise of keeping our community’s safe.

These value destroying leeches on humanity are bringing us into a worldwide state of severe survival pressure, and in the problem, reaction, solution dynamic they will offer you continued false flags, NSA surveillance, population reduction, financial collapse, central bank digital currencies, weaponized injections, GMO foods, social credit scores, 15 min. cities, kill boxes and a top-down world governance where reportedly you will own nothing and be happy.

These value destroyers will not stop their war on freedom until we muster the courage to stop them and stop them we must! It has always been the responsibility of all to defend their freedoms. If you are a free American, act like it!

The technologies of destruction are advancing to the point that our children and grandchildren will be nearly powerless against them.

And even if you are not ready to rise and assume the responsibility of self-defense, at least see the need to get informed and stop voting for your and my enslavement and definitely stop licking the boots of these pretend authorities, giving them the semblance of legitimacy.

I grew up on the mean streets of New York. I am very familiar with bait and switch. Walking the streets of New York City, I saw three-card-monte conmen setting up shop on sidewalks every day. Their goal was to distract you from picking the right card…and to separate you from your money.

Fox News settled with Dominion over claims of election fraud in the 2020 presidential election. Fox News will now pay Dominion $787 million because Fox News claimed the election was rigged by fraudulent voting machines.

Because Fox News settled with Dominion, now the Marxist-controlled mainstream media will go into full bait-and-switch mode. They will claim “the case is settled and closed. It’s now proven the 2020 election wasn’t rigged and stolen.”

What a scam. What a con. This is the all-time bait and switch.

I may be the TV and radio host most associated with reporting the 2020 election was rigged and stolen. I’ve said it thousands of times on radio and TV. I’ve said it from the day after the 2020 election to today. I’ll never stop saying it. Because it’s true.

The 2020 election was stolen.

And I believe elections are still being rigged and stolen. The 2022 midterms were almost as bad as the 2020 presidential election. One race is Exhibit A. Democrats clearly stole the Arizona Governor’s race from Kari Lake. Arizona Democrats rigged the vote by making sure vote tabulators didn’t work on Election Day in heavily GOP districts.

Democrats are rigging and stealing elections like the Swiss make clocks- with precision. It’s what they do. They rig, cheat and steal.

Yet in all these many years of my reporting and shouting and warning about stolen elections…I’ve never mentioned Dominion, or their voting machines. Because there are so many other simple, easy, low-tech ways Democrats steal elections.

Here is the Democrat playbook for stealing elections…

*No government-issued Voter (or photo) ID.

Did you know we are the only major nation in the world without government issued Voter ID? Did you know all the other nations acknowledge that Voter ID is necessary to prevent widespread voter fraud?

Did you know that Mexico requires government issued Photo ID plus a thumbprint?

Did you know U.S. territory Puerto Rico requires government issued Photo ID plus thumbprint to vote? Yet in America its “racist” (says Democrat frauds) to ask for the same thing required in a U.S. territory.

*Mail-in ballots handed to everyone (in many states mass mailed to voters without even asking), without Voter ID.

Did you know we are the only major nation in the world to allow mail-in ballots? Did you know all the other nations acknowledge publicly that mail-in ballots are a recipe for massive voter fraud?

But I’m just getting started. The 2020 election was stolen by…

*Five states colluding to stop the vote count on election night- for the first time in history. They sent all witnesses home, then they magically found enough votes by morning to overcome Trump’s huge leads- with no witnesses in the room.

*Ballot harvesting with no oversight– a practice that until Covid was criminal in 49 states.

*Ballot drop boxes with no oversight. If you don’t understand, please watch the movie “2000 Mules.”

*Little or no signature match on these millions of mail-in ballots.

*Counting fake ballots for days after the election. Ask yourself one simple question: What are the odds only Democrats have won every single time in history, after being behind on Election Night, and then a week of counting ballots? I’m no math genius, but I’d say the odds of that are 1 in a billion.

*Voter Rolls contain millions of inactive or improper registrations.

*Illegal aliens voting by the millions. In many states (like my state Nevada) it’s legal for illegal aliens to get drivers licenses. While at DMV they are automatically registered to vote. You don’t think they’re voting?

*How about $400 million dollars from Zuckerberg- to get out the vote only in deep blue Democrat districts. If Zuckerberg gave $400 million, how much did George Soros give to rig the election?

*How much did China give in illegal contributions to Democrats? We know Democrats took in hundreds of millions in suspicious donations from unemployed Americans. Where do you think that came from?

And the big one…

*We know the FBI rigged the election. They paid Twitter to change the news feed in favor of Biden and silence conservative voices on social media. See emails released by Elon Musk. The FBI rigged the 2020 election. FACT.

So, a FNC settlement with Dominion settles nothing. You and I know the 2020 election was rigged and stolen from a hundred directions.

How the Fraud Works for Generals

Information provided to H.E. Cardinal Mamberti and the Vatican Chancery Court in regard to our Claims, March 5th 2005, January 19th 2023, in seq:

When Rome conquered a native people, it first renamed them as a "tribe" owing "tribute" to Rome.  Now the conquered nation had a Roman name, just as they renamed Yeshuah and called him Jesus, instead.  Having a Roman name obligated these conquered nations to pay tribute to Rome. 

We trust that the name games involved are ringing bells --- using new names and foreign languages as the means to attach duties and debts and obligations  --- is a game that Rome has promoted for centuries.  

Rome next moved into the conquered "territory" and began to build roads, bridges, aqueducts, forts, and other public works for the administration of the new acquisitions. Rome began to teach Latin and Roman History and Roman religious beliefs and Roman social conventions and hierarchies, while not talking in the old native language of the people and not discussing their culture at all.  

Just like they took all the American History Books off the shelves and have been teaching nothing but United States History, instead.  

Next, it built homes and auditoriums and bath houses and temples and all sorts of buildings that, added to the roads, bridges, aqueducts, and forts, brought Roman customs, language, religion, holidays, and education to the hinterlands.  

While the Romans asserted their supremacy and superiority in all respects and encouraged the tribesmen to emulate Roman ways as much as possible, they also kept a keen eye out for any new inventions of worthy knowledge the conquered people might have to share.  

The great genius of the Romans is not the creation of knowledge, but the application of knowledge. 

Within two or three generations the tribes thus conquered had largely forgotten who they were and how they lived before the Roman conquest.

They considered themselves hybrids, not as lofty as the actual Romans, but proud to be trained in the Roman tradition and happy to have access to Roman infrastructure.  

In places like Britain, homegrown legions were raised and trained, and tribal princes studied the battles of Rome, Greece, Carthage and Persia, their imaginations captured by the lessons learned, and always, the glory of Rome.

And right behind the soldiers, sometimes out-running them, came the clergy: children, home-making, and church, solid moral values for tribesmen to follow, a cynical but effective means to keep them in line, predictable, and naïve. 

The same exact methodology is used today, simply updated to fit modern times and technology.  

The Roman technical gifts and infrastructure improvements are imported along with unique elements of its culture and religious traditions, and before you know it, whatever you were before, you are thinking and acting as a Roman.  

It's a bit like the Borg in Startrek.  And nobody notices.  Well, almost nobody. 

Rome took over German culture and created the Nazis, whose militaristic prowess and discipline and superman complex mirrored the modern face of the Ancient Empire; Mussolini might have seemed like Hitler's Second Banana, but that is another illusion--- a very crafty one. 

If the effort failed, the Germans would bear the brunt of it.  

The whole thing, World War II,  was engineered by Rome and bears its unmistakable imprint, right down to the swastika from their Aryan homeland in the Indus Valley and the red, black, and white colors of their flags. 

While they used the blond blue-eyed Northern Germans as their poster boys, it was the dark-haired, tight-skinned Tyroleans and Bavarians and Franconians who got the nod at Hitler's table. 

The same thing has happened to this country, and it's obvious to anyone who witnessed the transformation from the 1940's to the present and knows the Roman Way --- that is, the way they take over. 

Rome, in the form of its Municipal enclave in the City of Washington, DC, has always been a theocracy and the emblems of Rome are everywhere ---- swastikas and fasces (the odd bundles of sticks tied together) galore, great stone phallic symbols thrust up in front of the capitol dome.  

For anyone who knows anything about the Ancient World, it's apparent that we are living in a hybridized Roman world, under the sway of Rome's foreign values and foreign culture, and the leadership of the Romanized political elite is running headlong up against the values of the actual Americans.  

Here's our prediction: they are setting Trump up as the Savior of America after deliberately making Biden into a criminal laughing-stock.  Millions of Americans will get sucked into the same old schtick --- two sides to everything.  Just remember, it's the same nickel in the end.  

If Trump gets back in office, it will be a heyday for the military --- and the economy.  Everyone will be so relieved, they won't notice what's going on in China, but we will be fighting the rear-guard action to cover the Roman departure.  

Predictably, the Roman leadership has split things in two, to run its divide and conquer strategies more effectively.  

It has drawn the difference between Donald Trump and his Administration versus Joe Biden and his Administration in neon lights, inexorably driving the country into Trump's arms at the same time Biden courts China and prepares the next Roman conquest: China.  

China is in need.  It has over a billion people and nowhere near the resources it needs.  It can't stand alone, and look at the glittering technological superiority that Rome offers?  

The guilty Municipal Corporations are colluding just as they did when the Dutch East India Company pulled the Bottomry Bonds Scandal and had to beat feet out of Britain.  Then as now, the British are hamming up the Trump v. Biden mock fight, while they are setting this country up to pay for all their fraud and criminality and violence. 

The EU-backed Munis are trying to move to China, where they will benefit China with needed infrastructure and new technology stolen from our Patent Offices, which they conveniently manage in virtually every country worldwide.

Take a look, people --- SERCO, a Municipal Corporation, runs the United States Patent Office and serves as Paymaster for the United States Military.  

Yes, Rome will help China as a conquered country -- a new Roman Territory.  They will build infrastructure and they will bring technological wonders and advantages -- garnered from other people's patent offices, with the help of the British Monarchy and the Government of Westminster.  

Rome will also eat China alive, from the inside out, and use the Chinese people as fodder in their games. In a few generations a culture that has endured for over 5,000 years on its own will be Romanized. 

With all the good of Rome, comes all the evil. too.  

We have seen it before.  We don't need to see it again.  

The money that Rome creates comes from thin air, sex, war, and drugs.  Lots of drugs. Its wealth is built on deceit, lies, human misery, blackmail and conflict. It's been this way for 3,000 years. 

It's always been this way since the Sumerians, Minoans, Egyptians, and Greeks --- and the Romans, as usual, learned from these earlier cultures and applied what they learned. 

The Balbek, Knossos, Egyptian, Delphic, and Druidic Mysteries were all based on taking hallucinogenic drugs, with viper venom being the all-time favorite.  

Maybe that spike protein -- self-produced viper venom that attaches to the same exact receptor site as nicotine  -- is making more sense now?  

And observe ---- while everyone else chases silver and gold, which are relatively worthless commodities, somewhat akin to paper chits and digital keystrokes,  Rome hunkers down and destroys the breadbasket of Europe and blows the Nordstream pipelines. 

That's another lesson from Roman History.  

When the Romans, like parasites, move to a new host country, they destroy as much as possible of the old host as they leave.  

They poison the water (fluoride, etc.) and they poison the soil (chemtrail heavy metals and metallic incendiaries -- since 1989) and they set fire to things (like food production facilities and railways and oil refineries).  

The Romans deliberately poisoned every well and spring they could find as they left Britain, dumping large quantities of iron scrap into the wells.  

It's still there, for everyone to see, piles of Roman-era slag and iron scrap, still making the water poisonous for the native people, who are all iron intolerant.  

The Pandemic and the injections to pollute our blood and ruin our health are just par for the course, and pathetically predictable. Rome has regretted nothing and formed no conscience, in 3,000 years. 

We wish for the people of the world to wake up and see what is going on and pay attention, so that Rome (working hand-in-hand with its military counterparts in Constantinople and Jerusalem)  can't just go on and on and on, generation after generation, singing the same song and dance, playing the same obnoxious, destructive, self-serving, criminal, violent game and making everyone else pay for it. 

We wish for Rome to be recognized for what it is, and for the Saturnine Brotherhood to be ousted, so that the Earth and the rest of the people on it, can have peace and prosperity again.  

We wish for the Ecclesiastical Law to be upheld and for the lawless Municipal Corporations to be dealt with --- liquidation for most, and forfeiture and transfer of control of the essential services, including SERCO, which has caused quite enough trouble and purloined far too much power for itself.  

We wish for the return of our patents which originated in the United States Patent Office--- all of them, including the criminal products and processes which SERCO's Patent Clerks approved and provided to China under National Security wrappers.  

We remember who we are, even six generations after these foreign Municipal Subcontractors began their fraud schemes in Breach of Trust and violation of their Service Contracts. We are still here.  And we are still the lawful inheritors.

Evidence Considered by Honorable Jurors

There are, basically, four kinds of evidence: factual, circumstantial, eye-witness, and hearsay.   The first three, factual and circumstantial and eye-witness testimony, can be entered in a common law court case.  The fourth, hearsay, cannot.  

Factual evidence includes all those things generally admitted by the Defendant and the Public, such as, the Defendant was wearing a dark blue suit at the time of his arrest.  There was a full moon on the night of March 11th, 2022. 

Circumstantial evidence includes those things that suggest rather than prove things, for example, because the Defendant was wearing a nice suit, it's unlikely that he intended to be mucking out a barn.  

Eye-Witness Testimony includes all those things that other people directly see or hear and that they can directly attest to.  Joan Adams says, "I heard Philip Dean threaten Eli White.  He said, "If you mess with my bull again, you'll get something you don't like." -- and then he made a gesture with his fist, like he was chopping wood." 

Eye-witness Testimony is notoriously unreliable because people see and even hear things differently, and their testimony can be heavily colored by their own prejudices and assumptions. Still, it can be helpful in establishing the overall context of a situation, and if two unrelated people testify to hearing and seeing the same things, it lends credibility to the testimony.   

Irma Daniels, a cook who happened to be on break, heard Philip Dean say and do the same things as Joan Adams reported.  Now, we have corroborated eye-witness testimony from a disinterested Third Party, which provides strong testimonial evidence. 

If the Defendant agrees that yes, he said those words and made a gesture as described, the eye-witness testimony can safely be accepted as factual evidence.  

The one kind of evidence that cannot be admitted to a common law trial is "hearsay" evidence.  For example, "My Cousin Elsa saw Phil Dean that night and he was steaming mad at someone or something."  

Cousin Elsa might need to come forward and give her testimony, but her Cousin who is passing this information on secondhand didn't see or hear anything directly, so it's just hearsay, like gossip.  

And gossip, no matter how juicy, can't be allowed to color the deliberations of a jury.  

The evaluation of evidence requires us to think and think deeply. 

We have to look at the factual evidence and really ask ourselves how many ways can these facts be interpreted? Is there more than one possibility?  For example:  Philip Dean self-testifies that he came home from having dinner at a restaurant in town at about 8 o'clock on the night of March 11th and saw that his barn door was open.  

We can't confirm that with any other testimony, but it's a reasonable circumstance and it's affirmed to be true, so it is credible as long as nothing else contradicts or puts a different slant on things, like Sam Laughlin, a local carpenter, coming forward and testifying that, "I took Phil Dean's barn door off its hinges to repair it on the afternoon of March 11th.  It was laying flat on two sawhorses in the driveway, waiting for glue to dry that evening. Phil knew I did it and helped me move the door onto the sawhorses." 

So it wasn't just seeing a door ajar that shouldn't be ajar and going to check it out as Phil Dean's testimony suggested.  The doorway itself was standing wide open and Phil Dean knew why it was wide open.  

We now have corroborated testimony that the barn doorway was open--- literally open, and we aren't just talking about a door being ajar or swinging open on its hinges ---  but we are left wondering what prompted Phil Dean to go into the barn wearing a nice blue suit and why did he tacitly mislead us?   

Everyone responds the same way to seeing a door that is supposed to be closed ajar or hanging open, but if you know the door is being repaired and is on some sawhorses in the driveway, seeing the gaping doorway is to be expected. That in itself wouldn't prompt you to go look around the barn -- or would it?  

We have to think about what kind of evidence it is that we are receiving. We have to consider the source of the evidence.  We have to evaluate the quality and reliability of the evidence, piece by piece.  And at the end of the day, we have to develop a strong understanding of what, most likely, factually happened.  

We discuss our thoughts, questions and gut-feelings with the other members of the jury.  They bring forward their unique view of the same evidence. And together, we build a consensus based on the credible evidence --- and only the credible evidence. 

Ultimately, to the best of our ability, we answer the questions put to us: 

did Phil Dean kill Eli White?  If so, was it a premeditated act, or an accident?  

Serving as a Juror, especially on a Jury involving a capital crime, is a tremendous responsibility, and it is no wonder that many people try to avoid Jury Duty  --- but consider this: after a crime or other injury has occurred, wouldn't you want a fair trial conducted by a competent jury?  

You would want Jurors who were trained to consider the kind and quality of evidence, thoughtful, discerning Jurors, people able to determine both "the Law and the Facts" in a fair and even-handed manner. 

Many terrible acts of injustice have happened for lack of honorable and competent Jurors. 

So do unto others as you would have done unto you. When your State Assembly or County Assembly calls on you to serve as a Juror, be ready and willing to do the job to the best of your ability.  

Educate yourself to be a good and intelligent Juror, to fearlessly ask the questions that need to be asked in fairness to all concerned. 

American Common Law Jurisprudence has a long and honorable history and the American Common Law Courts that we are building are to provide ourselves and our children with the best system of justice in the world.  

To meet that supremely desirable goal, we need your participation, your thoughts, and your attention given to this urgent and important work, and to your potential role as a Juror.  

As a Juror, you may be an unsung hero, but we need heroes of all sorts.  The quiet kind who simply serve are often the best and bravest of all.
