Sunday Prayers for Patriots - The coming of Lent
The Introit of this day's Mass is the sigh of an afflicted soul confiding in God:
INTROIT Be thou unto me a God, a protector, and a place of refuge, to save me: for thou art my strength and my refuge: and for thy name's sake thou wilt be my leader, and wilt nourish me. (Fs. XXX. 3. 4.) In thee , O Lord, I have hoped, let me never be confounded: deliver me in thy justice, and set me free. (Ps. XXX. 2.)
COLLECT O Lord, we beseech Thee, graciously hear our prayers, and unloosing the bonds of our sins, guard us from all adversity. Through our Lord, etc.
EPISTLE (I. Cor. XIII. 1-13.) Brethren, if I speak with the tongues of men and of angels, and have not charity, I am become as sounding brass or a tinkling cymbal. And if I should have prophecy, and know all mysteries and all knowledge, and if I should have all faith, so that I could remove mountains, and have not charity, I am nothing. EXPLANATION In this epistle St. Paul speaks of the necessity, the excellence and the nature of true charity. He says that all natural and supernatural gifts, all good works, even martyrdom, cannot save us if we have not charity; because love alone can render our works pleasing to God. Without charity, therefore, though ever so many prayers be recited, fasts observed , and good deeds performed, nothing will be acceptable to God, or merit eternal life. Strive then, O Christian soul, to lead a pious life in love, and to remain always in the state of grace.
Can faith alone, as the so-called Reformers assert, render man just and save him?
Faith alone, however strong, though it could move mountains, without love, that is, without good works performed for love of God and our neighbor, can never justify or save us. For, when St. Paul says, that man is justified by faith without works, (Rom. III. 28.; XI: 6.; Eph. II. 8. 9.) he means to refer to those works which were performed by command of the law of Moses, and which, as they were external and without true charity, were of no avail; he did not refer to those works which are performed in a state of grace with a lively, love-inspired faith. Therefore the same Apostle writes to the Galatians: (Gal. V. 6.) Faith only availeth which worketh by charity; to Titus: (Tit. III. 8.) It is a faithful saying: and these things I will have thee affirm constantly: that they who believe in God, may be careful to excel in good works. These things are good and profitable unto men; and he exhorts the Colossians (Colos. I. 10.) to be fruitful in every good work. St. James confirms the same by saying: (James II. 17-24.) So faith if it have not works, is dead in itself; by works man is justified and not by faith only. That this is the true doctrine of Christ is evident from His own words, when He says: "Every tree that bringeth not forth good fruit, shall be cut down and shall be cast into the fire." (Matt. VII. 19.) At the day of judgment Christ will demand good works from all men, (Matt. XXV. 35.) and will not judge them only according to their faith, but by their good works, which true faith must always produce. (Apoc. XX. 12.) Would Christ and His apostles demand good works, if faith alone be sufficient? "The devil's also believe and tremble," (James II. 19.) they believe, but they are not saved, and their faith but increases their torments. Therefore, the assertion that faith without good works is sufficient for justification and salvation, is plainly against the doctrine of Christ and His Church, and must of necessity lead man to vice and misery, as shown by the history of the unhappy separation of the sixteenth century
Are good works available which are performed in the state of mortal sin ?
Good works performed while in a state of mortal sin avail nothing in regard to eternal life, writes St. Lawrence Justinian, but aid in moderating the punishment imposed for disobedience and the transgression of God's commandments. They bring temporal goods, such as honor, long life, health, earthly happiness, etc.; they prevent us from falling deeper into sin, and prepare the heart for the reception of grace; so the pious Person writes: "Do as much good as you can, even though in the state of mortal sin, that God may give light to your heart."
ASPIRATION O God of love, pour the spirit of true charity into my heart that, according to the spirit of St. Paul, I may endeavor to be always in a state of grace; that all my works may be pleasing to Thee, and meritorious for me.

Why did Christ so often foretell His passion to His disciples?
Because He wanted to show how great was His desire to suffer for us, for we speak often of that which we crave; and because He wished His disciples when they should see Him treated as a criminal and martyred, not to think evil of Him, or imagine themselves deceived, but remember that He had foretold all minutely that all happened of His own will.
Did not the disciples understand anything of what He predicted in regard to His future sufferings?
They may, certainly, have well understood He was to suffer, for which reason Peter tried to dissuade Him from it; (Matt. XVI. 22.) but they did not comprehend why or for what He would suffer, or how He would rise again. All this the Holy Ghost gave them to understand, after it had come to pass. (John XIV. 26.) The light of the Holy Ghost is of so much value, that without it even the clearest doctrines of faith are not understood.
Why does Christ so often call Himself the Son of Man?
He wished to show, in the Jewish way of speaking, He was also man, a descendant of Adam, and that we should be humble, and not seek or desire high titles.
Why did the blind man call Christ the Son of David?
Because, like all the Jews, he believed that the Messiah, according to humanity, would be of the house of David, as was promised. (Ps. CXXXI. 11.)
Why did Christ ask the blind man: What wilt thou that I do to thee?
This He asked, not because He was unaware of the blind man's wish, but to enable him the better to prove his faith and hope that through Christ he would receive his sight; and to teach us how willing He is to help us, and how it pleases Him if we confidingly place our wants before Him. We should learn from this blind man, who would not be restrained by the passing crowd in his ardent and reiterated request, not to pay attention, in the work we have commenced, to human respect, or human judgment, but to persevere, and not allow ourselves to be led astray by the world's mockery or contempt. We should also learn to be grateful to God, and faithfully cling to Him, if He has once opened the eyes of our mind, and healed our spiritual blindness, which is far more deplorable than physical blindness, for nothing can be more miserable than not to see and understand God, not to know what is necessary for our salvation, and what is pernicious.
Why is this gospel read on this Sunday?
The Church wishes to remind us of the painful passion and death of Jesus, and to move us by the contemplation of those mysteries to avoid and despise the wicked, heathenish amusements of carnival, sinful pleasures which she has always condemned, because they come from dark paganism, and, to avert the people from them, commands that during the three days of carnival the Blessed Sacrament shall be exposed for public adoration, sermons given, and the faithful exhorted to have recourse at this time to the Sacraments of Penance and the Blessed Sacrament of the Altar, with the reception of which Pope Clement XIII. (Breve, 23. June 1765) connected a plenary indulgence. A true Catholic will conform to the desire of his holy Church, considering the words which St. Augustine spoke, at this time, to the faithful, "The heathens (as also the wordly people of our days) shout songs of love and merriment, but you should delight in the preaching of the word of God; they rush to the dramatic plays, but you should hasten to Church; they are intoxicated, but you should fast and be sober."
PRAYER O most benign Jesus! who didst so desire to suffer for us, grant, that we may willingly suffer for love of Thee; that we may hate and flee from the detestable pleasures of the world and the flesh, and practice penance and mortification, that by so doing we may merit to be released from our spiritual blindness to love Thee more and more ardently, and finally possess Thee forever.
INSTRUCTION ON LENT
Who instituted Lent?
According to the fathers of the Church, Justin and Irenaeus, the fast before Easter was instituted and sanctified by Christ Himself; according to the saints Leo and Jerome, the holy apostles ordained it given by Jesus.
Why has the Church instituted this fast forty days before Easter?
To imitate Christ who fasted forty days; to participate in His merits and sufferings; to subject our flesh by voluntary mortification to the spirit, and to mortify our evil desires as did St. Paul; (Col. I. 24.) to enable us to lead a pure life, and thus prepare for the holy festival of Easter, and the reception of the divine Lamb, Jesus: and, finally, to render God satisfaction for our sins, and do penance, as Pope Gregory says, for the sins of one whole year by one short fast, lasting only the tenth part of a year.
Was the fast of Lent observed in early times as in the present?
Yes, but more strictly; for the people of the early ages not only abstained from meat, but also from all that which is connected with it, such as eggs, butter, cheese, etc., even from wine and fish, although this was not the general command of the Church; they fasted all day, and only ate in the evening after vespers, in remembrance of which, vespers are now said before dinner-time, because the Church, as a kind mother, now permits the supper to be changed into a dinner, and also allows something to be taken in the evening, that the body may not be too much weakened, and become unfit for labor.
How much does this ancient custom put to shame the Christians of to-day who think the fast in our times too severe! "But," asks St. Ambrose, "what sort of Christians are they? Christ, who never sinned fasted for our sins, and we will not fast for our own great and numerous offences?"
How should the holy season of Lent be spent?
As according to the teaching of St. Leo, the main thing in fasting is not that the body be deprived of food, but that the mind at the same time be withdrawn from wickedness, we should endeavor during Lent, not only to be temperate in eating and drinking, but especially to lead a modest life, sanctifying the days by persevering prayer and devoutly attending church.

Almighty God! I unite myself at the beginning of this holy season of penance with the Church militant, endeavoring to make these days of real sorrow for my sins and crucifixion of the sensual man. O Lord Jesus! in union with Thy fasting and passion, I offer Thee my fasting in obedience to the Church, for Thy honor, and in thanksgiving for the many favors I have received, in satisfaction for my sins and the sins of others, and that I may receive the grace to avoid such and such a sin, N. I therefore so run, not as at an uncertainty; I so fight, not as one beating the air; but I chastise my body, and bring it into subjection; lest perhaps, when I have preached to others, I myself should become a castaway. For I would not have you ignorant, brethren, that our fathers were all under the cloud, and all passed through the sea: and all in Moses were baptized, in the cloud and in the sea; and did all eat the same spiritual food, and all drank the same spiritual drink (and they drank of the spiritual rock that followed them: and the rock was Christ); but with the most of them God was not well pleased.
EXPLANATION Having exhorted us to penance in the Introit of the Mass, the Church desires to indicate to us, by reading this epistle, the effort we should make to reach the kingdom of heaven by the narrow path (Matt. VII. 13.) of penance and mortification. This St. Paul illustrates by three different examples. By the example of those who in a race run to one point, or in a prize-fight practice and prepare themselves for the victor's reward by the strongest exercise, and by the strictest abstinence from everything that might weaken the physical powers. If to win a laurel-crown that passes away, these will subject themselves to the severest trials and deprivations, how much more should we, for the sake of the heavenly crown of eternal happiness, abstain from those improper desires, by which the soul is weakened, and practice those holy virtues, such as prayer, love of God and our neighbor, patience, to which the crown is promised! Next, by his own example, bringing himself before them as one running a race, and fighting for an eternal crown, but not as one running blindly not knowing whither, or fighting as one who strikes not his antagonist, but the air; on the contrary, with his eyes firmly fixed on the eternal crown, certain to be his who lives by the precepts of the gospel, who chastises his spirit and his body as a valiant champion, with a strong hand, that is, by severest mortification, by fasting and prayer. If St. Paul, notwithstanding the extraordinary graces which he received, thought it necessary to chastise his body that he might not be cast away, how does the sinner expect to be saved, living an effeminate and luxurious life without penance and mortification? St. Paul's third example is that of the Jews who all perished on their journey to the Promised Land, even though God had granted them so many graces; He shielded them from their enemies by a cloud which served as a light to them at night, and a cooling shade by day; He divided the waters of the sea, thus preparing for them a dry passage; He caused manna to fall from heaven to be their food, and water to gush from the rock for their drink. These temporal benefits which God bestowed upon the Jews in the wilderness had a spiritual meaning; the cloud and the sea was a figure of baptism which enlightens the soul, tames the concupiscence of the flesh, and purifies from sin; the manna was a type of the most holy Sacrament of the Altar, the soul's true bread from heaven; the water from the rock, the blood flowing from Christ's wound in the side; and yet with all these temporal benefits which God bestowed upon them, and with all the spiritual graces they were to receive by faith from the coming Redeemer, of the six hundred thousand men who left Egypt only two, Joshua and Caleb, entered the Promised Land. Why? Because they were fickle, murmured so, often against God, and desired the pleasures of the flesh. How much, then, have we need to fear lest we be excluded from the true, happy land, Heaven, if we do not continuously struggle for it, by penance and mortification!

The want you dead! They are coming to KILL YOU, and nothing less. They want us all dead so they can take our stuff and live high on the hog. That is their only motivation, because they KNOW they can never have heaven when they die, so they are trying to get their heaven here on this earth!
In a way they have a death wish. They think that by being just as evil as possible in this life, they can erase their very existence in the next life. SORRY traitors. That isn't what happens when you die outside of God's Grace. What happens is that you get buried IN HELL forever and ever without end. You will reap the just deserts of your miserable existence on this earth REGARDLESS of how much to you try to avoid them.
As for us, we wish only for your conversion to the truth and your eternal salvation, but if you continue to persecute the faithful and you come at us with guns, and you don't believe in God, we will be happy to arrange for you to meet Him.

The problem is a lack of faith in God.
We always have a choice. Sometimes we are required to stand and tell the truth regardless of the consequences to our own person, which can lead others to a realization of the truth, and to action to correct the evils.
Look at the history of the martyrs in the time of Christ and after His death on the Cross. It seemed hopeless in their time to correct the evils of the Roman Empire, but because of their sacrifice the whole pagan empire went down and was converted.
Don't sell God short on His mercy and power! We each need to be Faithful in our own circle of influence and our spiritual lives, and let the rest to God who is still in complete control of His creation as He always has been.
The best advice I can give to these military men is this.
Get down on your knees and pray, like it's all up to God (because really it is), and then get up and work like it's all up to us (to show Him we are sincere and to make us worthy of His mercy on our country).
We can only die once, and the really scary part of that, is that if we don't die in His grace, we can't come back and do it over again, so repent and do some penance and by humility and steadfast faith in God, help your fellow man draw God's mercy to our Country. Then lead a good and holy life, to show those around you your goodness and thereby convert them to a different and better heart.

classified briefing for members of Congress which took place on Wednesday,
members found out that Snowden took with him:
· a complete roster of absolutely every employee and
official of the entire US Government.
· The names, home addresses, unlisted personal home
telephone and personal cellular phone numbers, dates of birth and social
security numbers of every person involved in any way, with any department of the
US Government.
· The files include elected officials, Cabinet
appointees, Judges, and **ALL** law enforcement agency
employees including sworn officers.
· Similar files with the personal information of EVERY
government contractor and all employees of that contractor!
· Similar files with all the personal information of
EVERY Bank Corporation, their operating officers and their Boards of Directors,
including all current and former members of the Federal
Reserve
· Similar files with all the personal information about
anyone holding any type of license from the Government such as Doctors, Lawyers,
Stock Brokers, Commodities Traders . . . . and many more.
· Similar files with all the personal information of
EVERY non-bank Corporation in the U.S., including their operating officers and
Boards of Directors.
Snowden has
made it clear that if he is arrested, if he vanishes, or if he "dies" from any
cause whatsoever, ALL of the information in his
possession will be published publicly.
TRN has
confirmed that, working through Julian Assange and his "WikiLeaks"
organization, copies of the encrypted data have already been distributed to more
than one-thousand, two hundred (1200) web sites around the world. Those sites
have agreed to conceal the information until such time as contact with Snowden
is "lost." Once contact is lost, the sites have been told they will receive the
Decryption keys via CD ROM, E-mail and P2P / Bit-Torrent file transfer. Once
the decryption keys are sent, the sites have been instructed to wait a specific
amount of time to confirm Snowden's disappearance, arrest or death and upon
expiration of that time period, to publish the decrypted
materials.
Making the situation all the more dire for the government is that
Snowden has made clear he will release some of the information under certain
"other" circumstances. For instance, if Martial Law is declared in the US or if
any elections are canceled for any reason, all the government employee info goes
out. If an economic collapse takes place, all the Banker/Stock
Broker/Commodities Trader information goes out. If Corporations start
hyper-inflating prices, all the information about them, their officers and Board

Leading
members of the House Armed Services Committee emerged from the classified
briefing “shocked” at the amount of information he reportedly took with him
beyond the NSA surveillance programs.
Rep. Mac
Thornberry (R-Texas), chairman of the Armed Service panel’s Intelligence,
Emerging Threats and Capabilities Subcommittee and also a member of the House
Intelligence Committee, said the briefing on the defense consequences of
Snowden’s leaks was “very highly classified,” and therefore details couldn’t be
discussed.
Thornberry did
say that lawmakers “left the briefing disturbed and angered” after hearing that
the leaks by the former Booz Allen Hamilton employee “went well beyond programs
associated with the NSA and data collection.”
He
characterized the leaks as so severe that they “compromise military capability
and defense of the country” and “could cost lives” — while they “will certainly
cost billions to repair.”
“His actions
were espionage, plain and simple,” Thornberry said.
Armed Services
Chairman Buck McKeon (R-Calif.) read his statement rather than making comments
on the fly “because of the seriousness of this issue and the sensitivity” of the
information they’d just heard.
“Ed Snowden
isn’t a whistleblower; he’s a traitor,” McKeon said.
No matter what
opinion people hold of the data collection programs, he added, people should be
“shocked and outraged to find that a substantial amount of the information has
nothing to do with the NSA.”

Edward Snowden represents the highest loyalty to our country, because he has the evidence of extensive treason on the part of government officials and employees and is willing to put his life on the line to see that they don't destroy our country with their treasonous actions. He only demands what is just and right, in that those employees and public servants SWORE AN OATH to the US Constitution and have broken that oath over and over. He is calling their bluff, and they are frantic to prevent him from exposing their treason to the world. He only wants justice. He only wants law and order. He only wants these criminals to answer for their crimes in the due process of law.
They will demonize him with every breath, and in the worst language. They will use their media puppets to make him look like a monster. He should be very gratified that what he is doing is bringing this kind of reaction because the best yardstick to our effectiveness in turning our country around has ALWAYS BEEN HOW MUCH THESE TRAITORS SCREAM AT US!
Now is the time to pour it on. Now is the time to expose every one of these traitors who are all criminals and have sold us down the river to satan and his minions. BY THEIR FRUITS SHALL YE KNOW THEM.

Japanese stock market crashing? What does this hold for America?
We have warned that this collapse was coming for
about 3 years now. It's just a matter of timing. There will be a global currency
reset, and this might be the beginning of the slide into oblivion for the US
dollar. The federal reserve banksters are having a very tough time keeping their
sinking ship above water now.
There is a currency war going on world wide for
power over the people and their labors and assets. This will NOT end until the
whole world is in chaos.

Stock Market In Japan Is COLLAPSING
Is the fiat money ponzi scheme beginning to crack, and near

Did you see what just happened in Japan? The stock market of
the 3rd largest economy on the planet is imploding. On Tuesday, the Nikkei fell
by more than 610 points. If that sounds like a lot, that is
because it is. The largest one day stock market decline in U.S. history is only
777
points. So far, the Dow is only down about 1000 points during this
"correction", but the Nikkei is down more than 2,300
points. The Nikkei has dropped more than 14 percent since
the peak of the market, and many analysts believe that this is only just the
beginning. Those that have been waiting for a full-blown
stock market collapse may be about to get their wish. Japan is absolutely
drowning in debt, their central bank is printing money like crazy and the
Japanese population is aging rapidly. As far as economic fundamentals go, there
is very little good news as far as Japan is concerned. So will an Asian
financial collapse precede the next great financial crisis in the United
States? That is what some have been predicting, and it starting to look
increasingly likely.
At the end of January 2013, Japanese stocks trailed only Portugal for the biggest rally among developed markets. Now the Nikkei 225 Stock Average is leading declines, slumping 8.5 percent last month and today capping a 14 percent drop from its Dec. 30 peak.As Bloomberg noted, much of the blame for the financial problems that we are seeing all over the planet right now is being placed on the Federal Reserve.
Losses snowballed in Tokyo during a global retreat that has erased $2.9 trillion from equity values worldwide this year amid signs of slower growth in China and stimulus cuts by the U.S. Federal Reserve.
The Fed created this bubble by pumping trillions of fresh dollars into the global financial system, and now they are bursting this bubble by starting to cut off the flow of easy money.
This is something that I warned would happen when the Fed decided to taper, and now RBS is warning of a "market bloodbath" unless the Federal Reserve immediately stops tapering.
Most Americans simply do not realize that our financial markets no longer resemble a free market system. Instead, they are highly manipulated and distorted by the central banks, and the trillions of dollars of "hot money" that the Fed has poured into the global financial system has infected virtually every financial market on Earth...
On Wall Street they call it "hot money"—that seemingly endless flow of cash that goes to the most profitable country du jour—but in the real economy it's gone cold.We never fixed any of the fundamental problems that caused the last financial crisis. Instead, the Fed seemed to think that the solution to any problem was just to create more money.
That hot money has come mostly in the form of a low-yielding U.S. dollar, which investors have borrowed en masse to fund investments in other higher-yielding currencies across the globe. The so-called carry trade has helped fuel an investment bonanza across the world that has boosted risk assets thanks primarily to the U.S. Federal Reserve's easy-money policy.
But with the Fed tiptoeing away from what initially was an $85 billion-a-month infusion of liquidity, investors are beginning to prepare themselves for a world of rising rates in which the endless cash flow to emerging market economies begins to ebb, then cease.
It was an incredibly stupid approach, and now our fundamental problems are worse than ever as Marc Faber recently noted...
"Total credit as a percent of the global economy is now 30 percent higher than it was at the start of the economic crisis in 2007, we have had rapidly escalating household debt especially in emerging economies and resource economies like Canada and Australia and we have come to a point where household debt has become burdensome on the system—that is, where an economic slowdown follows."So what comes next?
Well, unless the Fed or other central banks intervene, we are probably going to have even more carnage.
At least that is what Dennis Gartman, the editor and publisher of "The Gartman Letter", told CNBC on Tuesday...
"I just think you're going to have a very severe, very substantive and really quite ugly correction that will probably make a lot of people wail and gnash their teeth before it's done."Other analysts share his pessimism. According to Doug Short, the vice president of research at Advisor Perspectives, the U.S. stock market "still looks 67% overvalued".
Most sobering of all is what Richard Russell is saying. In his 60 years of writing about financial issues, he has never been "so filled with foreboding regarding what lies ahead"...
I’d be lying if I said that I wasn’t worried about the way things are going. Frankly, I’m truly scared for myself, my family and the nation. I have the sinking feeling that the stock market is on the edge of a crash. If that happens, investor sentiment will turn quickly bearish. And the bear market will start feeding on itself. Obviously smart heads and institutional money managers know that the US is semi dead in the water. And all the talk about an improving economy is just wishes and hopes. Bernanke’s dream of a flourishing new economy, improving without the need of the Fed’s help, is an idle dream.
I’ve been writing about the stock market for over 60 years and I can’t remember a time when I was so filled with foreboding regarding what lies ahead. The primary trend of the market, like the tide of the ocean, is irresistible, and waits for no man. What scares me the most in this current situation is that I see no clear island of safety.
U.S. stocks may not totally crash this week, this month or even this year, but without a doubt a day of reckoning is coming. As a society, our total consumer, business and government debt is now equivalent to approximately 345 percent of GDP.
The only way that the game can continue is to keep pumping up the debt bubble even more.
Once the debt bubble stops expanding, it will start collapsing very rapidly.
Those that foolishly still have lots of money in the stock market better hope that the Federal Reserve decides to intervene in a major way very soon.
Because if they don't, there is a very good chance that we could indeed have a "market bloodbath" on our hands.

I will go one step further. This will get so bad so
fast that small banks will get caught in the flush. Get your money out of banks
entirely and keep only enough to pay bills. When we buy from our suppliers we
normally send cashiers checks, because that way the money is gone when we walk
out the door of the bank.

scenarios won't go that far, but do you really want to take that
chance?

10 Meter ham radio regulations update and evidence
As promised we have been digging into the situation on the importing, sales, and use of the 10 meter, or 10 and 12 meter only, so called "export" radios coming into this country by the thousands.

On the one hand there are hundreds of legitimate radio wholesalers buying these radios from importers and manufacturing companies, and reselling them to dealers across the country who sell them to anybody that has the money.
On the other hand there are ham radio companies that won't touch them with a 10 foot pole with a red hot poker on the end. Some claim is made by some hams that they are ALL illegal CBs and that anyone that buys one has "rocks in his head". I actually heard that from one extra class ham recently.
Let's try to sort this out. The first piece of "evidence" we present is a document furnished to me, to back up the claim that all these 10 meter only "export" radios are totally illegal to import, sell, and use in the USA by anyone, even a licensed amateur radio licensee.
Now remember while you are reading the link below, that there are literally thousands of this type of radio coming into the country through US Customs as we speak, and they are being sold to absolutely anyone that cares to buy one, including dealers and end users nation wide. Also remember that each and every one of them WILL NOT TRANSMIT on the CB band (40 channels) in the configuration they are in when they came into the country. In that configuration, transmit on CB channels is blocked by some internal circuitry which has to be defeated before they will transmit on CB frequencies (11 meters).

The question we are asking and have been researching is this:
If these radios are used in the configuration they are in when they are imported (CB transmit blocked) by a ham radio operator with a valid Technician class or above license, and if they are used only on ham frequencies in the 10 or 12 meter band as the case may be, and NOT used to transmit on the CB frequencies (40 channels class D CB) and remain unmodified to transmit on CB, is it illegal for that licensed ham operator to buy, own, and or use that radio on the ham band segments of the spectrum their class of license is authorized for?
There is a certain amount of evidence to wade through to get at the answer, and the next piece to the puzzle might be the following case from an FCC citation in 2005, where a radio dealer was advertising these radios as both ham and CB radios, and was modifying the radio to work on CB frequencies. Bear in mind that the FCC usually issues warning letters at least once and probably several times before they issue a citation, so this dealer probably ignored the warnings and was cited. I don't know the eventual outcome but will comment on the citation itself after you read it.

Notice that in this citation many of the same models of radios are on the list as in the first letter, and also I would like to point out that several certified CB radios, that ONLY transmit on CB frequencies, are on the first list, but not this last one. Those are Galaxy models DX919, DX929, DX959, DX979, DX2547. These Galaxy models have always been certified CB radios running legal power levels of 4 watts AM and 12 watts SSB max. The interesting thing is that they don't appear on the official FCC citation which is a legal document, while they do appear on the first document, which leads one to believe that the first document is not an official FCC document at all, but someone else trying to steer the market in their own direction. In fact one of the wholesalers that I have bought many thousands of dollars worth of merchandise from for 2 decades who also handles the 10 meter "export" radios as well as many models of certified CBs, was very convinced the first article is entirely bogus. Here is his comment:
"This list is not from the FCC. Some Amateur radio organization made it. Take a look. Five of the models listed under Galaxy are FCC Type Certified CB models."
The real telling part of this citation is in section 3. Here is the pertinent part:
"Section 2.803(a)(1) of the Rules provides that “… no person shall sell or lease, or offer for sale or lease (including advertising for sale or lease), or import, ship or distribute for the purpose of selling or leasing or offering for sale or lease, any radio frequency device unless: (1) In the case of a device subject to certification, such device has been authorized........."
None of these radios are certified because they qualify as Ham equipment and ham equipment is not subject to certification except Amplifiers! They go on to explain in part 5 why this type of dual use ham equipment is NOT certified.
From the citation:
"Additionally, dual use CB and amateur radios of the kind at issue here may not be certificated under the Commission’s rules. Section 95.655(a) of the Rules6 states “….([CB] Transmitters with frequency capability for the Amateur Radio Services….will not be certificated).” See also FCC 88-256, 1988 WL488084 (August 17, 1988). This clarification was added to explicitly foreclose the possibility of certification of dual use CB and amateur radios, see id., and thereby deter use by CB operators of frequencies allocated for amateur radio use."
They are clearly trying to protect the amateur radio operators from getting illegal traffic on the 10 and 12 meter bands, and having the same situation on those bands as the current mess on CB frequencies. The whole truth that they don't say here is the absolute undeniable fact that NO ham equipment is required to be certified with the exception of external RF amplifiers. NO equipment including the radios that many hams build FROM SCRATCH, and put right on the air, need any certification whatsoever by the FCC, period. Ham radio has always been about research and development, and if we had to go beg some government agency every time we had a good idea for a radio device most of the great inventions in radio just simply would not exist today.
CB radios ARE subject to certification, but these "export" radios are not being imported as CB radios, and are not sold as such unless the dealer is modifying, or offering to modify them to do the CB band. And that, my friends, is when the FCC gets excited and starts sending out warning letters.
Everyone seems to have a different opinion. Here is one quote from one of the ham forums when they were talking about "dual use" radios.
"What modern transceiver from ICOM, KENWOOD, ALINCO, or YAESU is NOT "easily converted to coverage outside 10m as are other radios of this type"? To get general coverage transmit on these Ham radios requires no more effort than what is required to expand the coverage of these 10 meter radios. I am not supporting illegal out of band operation, but lets be honest about this. The problem does not only involve these 10 meter type radios."
So now back to my question. What is the answer? Can licensed ham operators buy, and use one of these "export" radios if they stay in the ham bands, and operate within the guidelines for their class of license, and the guidelines for the ham band they are on, and never modify the radio to do the CB bands?
Remember, we are looking for something official, and definitive here. We are looking for something right out of the horse's mouth, so to speak. While the following won't be the end of our research because we think the question in this communication from the FCC was not very well worded, this answer from the FCC is spurring us on to dig out some of the actual court cases and how they were resolved, so stay tuned, because it seems that in the following determination with the case ID number HD0000002214012 it says they CAN be used in the ham bands. Is this actually true, or is it the FCC trying to set up another sting operation so they can cite, and fine more people? You decide, but stay tuned. We are going to find the answer.

And when they do some kind of enforcement action, and pick just one person to persecute, isn't that selective prosecution? Why not shut the whole thing down? If you want more on 'selective prosecution' just do a search on the term. The internet is full of evidence from law libraries and cases showing selective prosecution is totally unlawful.

"Section 2.803(a)(1) of the Rules provides that “… no person shall sell or lease, or offer for sale or lease (including advertising for sale or lease), or import, ship or distribute for the purpose of selling or leasing or offering for sale or lease, any radio frequency device unless: (1) In the case of a device subject to certification, such device has been authorized........."
None of these radios are certified because they qualify as Ham equipment and ham equipment is not subject to certification except Amplifiers! They go on to explain in part 5 why this type of dual use ham equipment is NOT certified.
From the citation:
"Additionally, dual use CB and amateur radios of the kind at issue here may not be certificated under the Commission’s rules. Section 95.655(a) of the Rules6 states “….([CB] Transmitters with frequency capability for the Amateur Radio Services….will not be certificated).” See also FCC 88-256, 1988 WL488084 (August 17, 1988). This clarification was added to explicitly foreclose the possibility of certification of dual use CB and amateur radios, see id., and thereby deter use by CB operators of frequencies allocated for amateur radio use."
They are clearly trying to protect the amateur radio operators from getting illegal traffic on the 10 and 12 meter bands, and having the same situation on those bands as the current mess on CB frequencies. The whole truth that they don't say here is the absolute undeniable fact that NO ham equipment is required to be certified with the exception of external RF amplifiers. NO equipment including the radios that many hams build FROM SCRATCH, and put right on the air, need any certification whatsoever by the FCC, period. Ham radio has always been about research and development, and if we had to go beg some government agency every time we had a good idea for a radio device most of the great inventions in radio just simply would not exist today.
CB radios ARE subject to certification, but these "export" radios are not being imported as CB radios, and are not sold as such unless the dealer is modifying, or offering to modify them to do the CB band. And that, my friends, is when the FCC gets excited and starts sending out warning letters.
Everyone seems to have a different opinion. Here is one quote from one of the ham forums when they were talking about "dual use" radios.
"What modern transceiver from ICOM, KENWOOD, ALINCO, or YAESU is NOT "easily converted to coverage outside 10m as are other radios of this type"? To get general coverage transmit on these Ham radios requires no more effort than what is required to expand the coverage of these 10 meter radios. I am not supporting illegal out of band operation, but lets be honest about this. The problem does not only involve these 10 meter type radios."
So now back to my question. What is the answer? Can licensed ham operators buy, and use one of these "export" radios if they stay in the ham bands, and operate within the guidelines for their class of license, and the guidelines for the ham band they are on, and never modify the radio to do the CB bands?
Remember, we are looking for something official, and definitive here. We are looking for something right out of the horse's mouth, so to speak. While the following won't be the end of our research because we think the question in this communication from the FCC was not very well worded, this answer from the FCC is spurring us on to dig out some of the actual court cases and how they were resolved, so stay tuned, because it seems that in the following determination with the case ID number HD0000002214012 it says they CAN be used in the ham bands. Is this actually true, or is it the FCC trying to set up another sting operation so they can cite, and fine more people? You decide, but stay tuned. We are going to find the answer.

If, in fact, these radios are illegal to import, and sell, and use, then it begs the question, Why does the FCC and the US Customs continue to allow them to be imported and sold? And when they do some kind of enforcement action, and pick just one person to persecute, isn't that selective prosecution? Why not shut the whole thing down? If you want more on 'selective prosecution' just do a search on the term. The internet is full of evidence from law libraries and cases showing selective prosecution is totally unlawful.

The FCC 10 Meter Export Radio Trap to Fleece the Public.
As a licensed Amateur Radio operator since about 1995 (now general class, KC7MEZ), and a volunteer examiner #1524 class G, I am constantly trying to increase the participation of the public in ham radio for safety and emergency communications for what we believe will be some really tough times in America in the very near future.

In the last few days I have run into something that really gets me fired up, and as usual it involves one of those alphabet soup federal agencies, the FCC. First I will tell you the story of how the FCC ruined the amateur 11 meter band, which is now known as the CB band.
The Amateur 11 meter band was one of our best long distance daytime ham bands, because during the daytime the sun drives the ionosphere close to the earth, and signals with a wavelength longer than about 10 meters in length will bounce back to earth. This is called propagation, and made it possible to talk around the world on 11 meters when the band was good. Then on September 11th 1958 the FCC took the 11 meter band away from ham radio and created the class D citizens band as a licensed 23 channel band in the 27 MHz frequency range, with the first 22 channels taken from the ham 11 meter band. The hams were vehemently opposed to this move. The amateur community told the FCC that those frequencies would never work for a licensed band for many reasons. The first reason is the propagation, which is the very thing that made 11 meters so valuable to hams. They reasoned that since CBers wanted to have dependable local communications for many personal reasons as well as for business, safety etc. there would be a problem with interference from people out of the local area that would stop local communications altogether, or make it very difficult to have a readable local conversation, or at the very least would cut down the range of those local communications to the point that the band would become unusable for any dependable local communications.
It didn't take long for exactly that to happen. I remember my own first involvement. My CB call sign was KPF4162, and my first radio was a Johnson Messenger III mobile. I had it mounted in my car, and in the early and middle 60s there were not many people to talk to, but by 1977 there were so many people using CB that the FCC expanded the band to 40 channels, and then later in the early 80s the FCC abandoned their license requirement entirely and threw the band open to license free operation. The main reason for this admission of failure is that with the propagation and large participation of people, many using large illegal power amplifiers, the band became mostly unusable for local business or safety communications because of interference from out of the local area. In short the FCC picked exactly the wrong frequencies to use for a local business and personal radio service. Today you might be talking to somebody a few blocks away and somebody in another state running hundreds of watts might key down and blow you right off the air. According to a Wikipedia article on this the FCC originally intended that this new CB band be a poor man's business-band radio service. Well, so much for business use on CB! So now we have a mess.
Here is the rub.
The FCC still wants us to follow all their other rules about CB including power maximums, but they have completely LOST CONTROL of the entire band. They now selectively prosecute a few grievous offenders that run lots of power and maliciously interfere with local television or other CBers or once in a while when they think they can levy a big fine, they cite someone for selling what they consider to be illegal CB equipment. In effect the FCC has created a whole bootleg black market for illegal power in the form of RF amplifiers that can legitimately do some of the ham bands, but also will amplify 11 meter signals far beyond the 4 watt AM or 12 SSB legal power levels. The same has happened with a whole class of radios that have come to be known as 10 meter "export" radios. These radios can all do legitimate ham frequencies including 10 meters, and some do 12 meters, but they all are easily modified to also go on the CB 11 meter band with very simple modifications like plugging in a jumper, or removing some diodes.
Now get this.
THESE RADIOS ARE STILL BEING LET INTO THE COUNTRY THROUGH CUSTOMS.
You would think US customs would follow what the FCC is telling them to let in, and what to block. There are literally hundreds of thousands of these 10 meter "export" radios being allowed into the country.
The FCC just looks the other way and shrugs. They put out guidelines and lists of "illegal radios" but then they never stop them from coming, and from being sold all around the country. They just refuse to enforce their own guidelines which creates the black market.
There are conflicting reports as to the legality of the importing of these radios, and we are currently involved in trying to get the cases sorted out, but it's a big blur as to what the FCC really has given, as to any kind of enforceable policy. It seems they want the blur and confusion. They want the gray area so they have some easy way to hang people they consider targets, or maybe where they think they can levy big fines.
Once again, a government agency has made a whole class of regulations that allows them to ignore enforcement unless they want to enforce it. They, in effect, have baited a trap, and are waiting for their prey. This creates problems for people who want to do things according to FCC regulations and who are licensed hams, or are ham radio dealers who want to play by the rules..
Hams, for example, can run legally on 10 meters, and 12 meters, and in the case of a tech class ham, which is the lowest license class in ham radio, they can legally run up to 200 watts of power on 10 meters between 28.3 and 28.5 Mhz. But in order to do that legally, according to the FCC, they have to buy an all band HF ham rig that would probably cost upwards of $700 to $1000 at a minimum, instead of a 10 meter only radio that may cost only$300 to $400, and that would operate perfectly WITHIN all of the ham radio guidelines and all the operating parameters of the FCC for ham radio.
According to the FCC, there are no such radios in America that are 'legal' or approved by the FCC. They have this big long list of 10 meter export radios that are all "banned" for import and sale, but then they look the other way and let every company that wants to build one import them or sell them throughout the country, thereby setting up millions of people for big fines and confiscation of not only their radios, but their entire businesses and in the case of one man that I know of that is now deceased they even took $16K out of the proceeds from the sale of his house.
Not only that, but if the rules were clear about who could run what type of radio, it might make it possible for the manufacturers to make a radio the would be an entry level 10 meter all mode transceiver that did everything on 10 meters, and get the cost down much further yet, perhaps even under $200 per radio depending on power capabilities. This would increase the availability of much more powerful and longer range communications to former CBers who might want to get their technician license, who are now bootlegging illegal power on the CB band, and would help to clean up the CB band, and decrease the temptation for CBers who are not licensed to come up on the 10 meter ham band and operate without a proper ham callsign. We hams are very good at policing our own frequencies, and if someone shows up without the proper call sign, nobody would talk to them, since they are not in the call sign directory at www.qrz.com.
Here is the real issue. We have a government agency that is guilty of entrapment and selective prosecution by administrative edict, and extrajudicially stealing from people without due process, just like almost every other government agency is doing at this time. FCC regulations are NOT laws. They are regulations. And the big one is that the FCC doesn't even follow their own regs. They LOOK THE OTHER WAY after creating their big long list of so called "illegal" radios, and continue to let the manufacturers of those radios import and sell them by the hundreds of thousands right here in America. It's like trolling for fish. They get some unsuspecting radio dealer to bite, and make a small infraction, and then they pounce on them and take all their stuff, and fine them big money, for what? They have lost control of the entire band anyway, so that makes their actions nothing but persecution.
And what about the radio dealers that play by the rules, and refuse to sell any of these "export" radios?
How much money are we losing to this black market?. As a radio dealer for the last 22 years both in retail and internet sales how much money have I lost since being forced by the gray legal area to abstain from this market? How much have the properly licensed ham operators paid over the years for these bad decisions from the FCC?
What are the solutions?
First, the FCC could put out some really clear guidelines and then enforce them across the board for everybody. And if their regulations are not enforceable, then take them off the books, and stop selective enforcement and selective prosecution which are both unlawful!
Second, and better, the FCC could just get the heck out of the way, and remove those regs, and open up the market. The CB band is lost anyway. WHY NOT GIVE IT BACK TO THE HAMS?
Legalize all the 10 meter export radios, and then require anybody that uses one to have a proper ham callsign. That is not as difficult as you might think it is. None of the ham license classes require learning the morse code at all any more. The license is free. It comes with some really good training and a test.
The test is simple. 35 questions, which are all multiple choice. You can get 9 questions wrong and still pass the test and get your license. The license is FREE for 10 years, and then you can renew on line for another 10 years without any cost. The only time you would start over is if you want a different call sign, or if you want to upgrade to general or extra class.
Then give the 11 meter band including all the new frequencies in the upper channels to the Ham community where it belongs. But with one new twist. On this band, and only this 11 meter band, let the hams and everybody else use it for business communications. Yes, LET EVERYBODY use the old CB 40 frequencies for business use, but as a licensed amateur radio operator who KNOWS WHAT THEY ARE DOING. The only difference from now is that they will need a call sign as at least a tech class ham.
They can keep on running their same CB radios on those frequencies, and any of the new 10 meter export radios opened up for 11 meters, but they will have to do so, with proper training, and authorization, and policed by the ham community, NOT THE FCC.
We are much better at keeping a band clean and useable than the FCC ever was. The CBers could get the tech class license without much trouble, and then they would know how to get the most out of their radio communications. With a callsign requirement they would be required to operate according to proper protocol as we do on all the other ham bands. They would get the extra benefit of a legal 200 watts of power, and especially on SSB, but just on those frequencies which were formerly CB channels, AND they could use those same radios for business use. They could call somebody and order parts for their logging machine or whatever. This is what the FCC originally intended. That the CB band would be a poor man's business band radio service.
The manufacturers would not have to change a thing, except abide by the FCC rules for cross frequency interference, and intermod, like any transmitter is required to do now.
As always the solution to our problems in this country involve having LESS GOVERNMENT not more.
Let's get rid of the agencies that are interfering with our prosperity and freedom, and stop the legalized plunder of the public with administration persecution for every little infraction, and let real practical people help their neighbors to become better educated about this technology so they can accomplish what their personal communications needs demand.
How about it FCC? How about it Hams? Are you willing to solve this problem. Are you willing to take this bull by the horns and wrestle him to the ground, and reign in the problems of bureaucratic over reach?
Are you ready to make this whole black market disappear in a heartbeat, with no real added expense by a simple ruling from a government agency that for once would actually solve a problem and make people MORE FREE and better equipped for emergency, safety, and business communications?
