The name change must have been on motion by the father and his counsel because judges usually don't do anything on their own motion. The UCC has nothing to do with the passport. They are 2 separate processes. You state your claim in the public on the UCC-1. You can attach the COLB to it if you like to support your claim and natural right as the mother. You would also need a Security Agreement that has been breached and an Affidavit of Obligation/Commercial Lien as your basis for the UCC lien. The BC and UCC are separate processes. First order your 2 COLBs (Certificate Of Live Birth) from your native country (England for yourself and the state where your kids were born for them). You will need one to surrender the federal person to the treasury and the other for a new passport. Have the SOS (Secretary Of State) or whoever does this in England, authenticate your COLB (some countries call it certification or attestation, but you do NOT want an apostille). Once you receive these back, send them to the SOS in DC (Rex Tillerson) for Authentication. This is a must for you since your entry into the US was DC. DC Authentication is optional for your kids if they were born here. In the meantime you can already file UCC-1's on each child in the county where they live as well as the state where they were born. The UCC-1 will make you the only one with a legitimate claim to your children's NAMEs. Next you are going to apply for a new non citizen state national passport for yourself and for your children. You are going to surrender your US citizen certificate in exchange for a Florida State Citizen (note the capital C) Passport. For your kids you are going to apply for a new Florida State Citizen passport as well and return their old passport if any or complete a lost passport form if you cannot get your hands on them. For the passport process, go to destinationfreedom.org and sign up for the citizenship class and after that the passport application class. Once issued, you are going to request certified copies of the application upon which they issued the passports which is your proof determined, affirmed and certified by the SOS under his seal and signature on behalf of the DOS that you and they are not US citizens and not subject to US jurisdiction. They are your children by nature and you are now the only claimholder to their NAMEs. However, in rereading the statute, I just realized that "the following may be recorded" means that YOU may record it and that they cannot object except perhaps in the filing procedure and if so they must help you by explaining how to correct it so that it can be recorded. IOW: they cannot deny you and say that you may NOT record it. I would start a paper trail. I read somewhere that once you mail it to the County Recorder Registered Mail, that it is already considered recorded and that they must provide you with a valid and lawful reason if they reject your recording. But then you will have their reason on paper which is actionable. IOW: they will have to counter your MAY record statute with a MAY NOT statute which they do not have. Then you respond and state: "The law states that I may record this document and you cannot deny recording this pursuant to Statute XXXX since it is already recorded elsewhere. Please provide the statute and code you are relying on to justify your denial. Or, if you have determined an error in the filing, please state how to correct the filing that it may be recorded." Put the monkey on their back. Usually all you get back with your documents is a fluff form letter without any reason simply stating that they cannot record your documents hoping you will simply go away. You have to take them to task to prove their position or to record it. Put up or shut up! The only valid argument they could have is the "prerequisites to recording" which you can simply counter with "Please provide me the prerequisites to recording that will allow my document to be recorded."<br />If you are doing this in person, a GREAT question to always ask them is: "Are you making a legal determination?" which will make them recoil at once. You can also ask them: "Who do I complain to if you cannot help me?" They said it doesn't fulfill their filing requirements for a Deed of Reconveyance which is intended for loan repayment on real estate property. They said I needed to have the original owner (Trustee) of the property, even though I explained I am the original owner. Maybe if I put my parents names as the original Trustees? But I also need the original "deed".
